——以专利侵权的判定为视角
中文摘要
专利权利要求的解释是整个专利制度运行过程中最为核心的问题并贯穿于其运
行的全过程。从各国的专利实践来看,对权利要求的解释最为广泛地运用于解决专利
权属争议的专利侵权环节中。专利侵权是一个动态的、具体的过程,判定侵权的前提
是界定专利权的保护范围。如何判定被控侵权的产品或方法是否侵权,具体说来就是
首先界定该产品或方法权利范围,进而通过比对二者的权利要求,得出其是否落入原
专利权的保护范围。专利侵权诉讼的权利基础在于专利权人拥有专利权。但专利权作
为一种无形财产,其保护范围是以文字表述的权利要求的内容为准,因此权利范围并
不像有形财产那么明确,有时甚至是不稳定的。因此,如何解释权利要求成为合理确
定专利保护范围的关键问题。
“以公开换取保护”是专利制度的核心理念,其要求在专利制度运行过程中兼顾
保护和公示两大功能。解释权利要求的天平是倾向于保护专利权人还是倾向于维护社
会公众的权益,也是左右着解释尺度松紧的重要因素之一。因此,在专利侵权判定过
程中,很有必要探究如何灵活适用权利要求的解释原则、解释方法,明确各类型证据
的作用、运用的效力等问题,尽量寻求专利权人个人的私益与社会长远发展的公益之
间的平衡。
本文立足于我国现行专利制度,对世界上发达国家如何通过解释专利权利要求来
判定专利侵权的相关理论和实践进行研究,探讨符合我国实际的权利要求解释规则。

Abstract
Patent claim explanation is the most core of the whole operation process of the patent
system and throughout the course of its the patent practice around the
world,the interpretation of the right to ask is the most widely used in the patent
infringement,which links of patent ownership infringement is a dynamic,
concrete is based on defining the scope of protection of the patent to
determine whether the accused infringing products or methods causes infringement,in
that,define the patent range of the product or method first,and then through parison
of the two claim,which concluds that if it fell into the original scope of protection of the
patent patent infringement lawsuit requires the patent holder in the possession of
the patent right,as a kind of intangible property,its protection scope is subject to
the patent claim content,which is in the written expression,so the right scope is not as clear
as tangible property rights range,even sometimes , how to interpret the
claims is a key issue in the
