文档介绍：摘要摘要司法改革在中国社会处于巨大变革、深层矛盾开始显现的世纪之交,处于为艰的境地,在比较改革的进路时,作者选择了审判制度这一中观制度概念和合法性与合理性分圻角度。合理性、合法性是哲学与社会学对于社会制度、社会规范进行研究的方法与维度, 洚者梳理了相关哲学、社会学学者关于合法性、合理性的思想,同时,对法哲学、法理学的相关思想得出了关于合法性、合理性及审判制度的思想、方法、观察角度。现实中的审判制度四个具体审判制度部分,都存在着理论支撑、制度特性、审判规范、法官管理要求、法院管理的要求等层次,作者对其进行概述的基础上,分别进行形式合理性、实质合理性、形式合法性、实质合法性分析并提出相应的对于法官管理、规则立法的要求;在理念、理论论证的同时结合选择典型的规则分析、案例分析。作者依据“理性相对性”的原则与中国的现实社会条件提出了完善审判制度:建立法院运行的保障机制和科学、有效的法院内部管理枫制;建立科学、系统的法官管理体系;强化判决论证说服规则等建议。关键词审判制度合理性合法性 Abstract Judicial reform has been in avery difficultcondition when Chinese society has been going through greatchange and thedeep contradiction begin app6aring during theconection oftwo theconsequence paring theway ofreform,the author choose try system which isthemoderate concept andanalysing angle oflegitimacy and rationality. Legitimacy and rationality are themethod and latitudeofanalysing society system and norm withsociety andphilosophy author analysed theothertheory oflegitimacy andrationality,and got thetheory,method andangle oflegitimacy,rationality and trysystem The trysystem inreality,includes four concrete parts,has differentlevelsofsupporting theory,specific characteristicof system,try standard,administration demand ofjudge and introducing thetheory,author analysed formal rationality,substantive rationality, formallegitimacy and substantive legitimacy,put forward thedemand ofadministering judge and legislation on thedemonstration ofthetheory andanalysing thetypical ruleand case. On thebasisofrationalrelativity and Chinese society condition,author put forward the advice ofperfect町system,establish ensuring system ofcourtworking and effective administering system ofinsidecourt,establish scientificandsystematic administering judge s3,stem,strongthen analyse and persuade rule.
