摘要

以互联网为支撑的网络经济大潮已席卷整个世界,广泛地影响和改变
着传统企业的经营方式和普通公众的生活方式,也影响和改变着政府的管
理方式。我国电子商务的发展只有短短的十年不到的时间,在取得巨大成
绩的同时,带给国人更多的是发展中急需解决的许多问题,例如各种网络
犯罪行为日益增多,网络不正当竞争行为日益突出,网络消费者合法权益
难以保障,网络侵权行为愈演愈烈等,严重影响了电子商务的健康发展,
并在一定程度上影响了国家经济的健康运行和和谐社会的建设。工商行政
管理机关是国家主管市场监督管理和行政执法的重要职能部门。工商部门
监管电子商务经历了一个由不认识到逐步认识,由不自觉到逐步自觉的过
程。各级工商行政管理部门勇于实践,积极探索,大胆创新,积累了许多
好的做法和经验。但在实践工作中,仍然存在不少问题,个别地方甚至存
在监管空白的状态。事实已经说明,电子商务的发展给我国的工商行政管
理带来了前所未有的挑战和机遇。作为一名从事基层工商行政管理工作的
国家公务员,笔者希望通过这一领域的研究,用自己的所学所想,结合实
际工作,寻求加强对电子商务进行监管的对策,为我国电子商务的健康发
展尽绵薄之力。
本文共分为五章。第一章绪论主要阐述论文研究的目的意义、研究综
述以及研究思路与方法等。第二章主要对电子商务相关内容进行了概述,
指出了我国电子商务发展的突出问题,提出了政府介入监管的公共管理理

论基础,明确了工商行政管理监管的主要职责,强调了工商行政管理介入
电子商务监管的必要性与独特优势。第三章主要阐述工商行政管理监管电
子商务的现状,并深入分析了监管存在的问题及原因。第四章介绍了美、
日、欧等发达国家政府监管电子商务并促进其发展的做法以及对我国政府
监管电子商务的借鉴。第五章主要从更新观念、革新管理体制、建设信息
平台、加强立法以及培养人才等方面,提出了工商行政管理监管电子商务
的对策。

ABSTRACT

E-economic, supported by the has swept through the world and it
widely influents and changes not only the traditional business mode of operation
and the public's life way, but also the government's management methods. Along
with the rapid development of merce in bringing us to facilitate, fast speed,
and efficiency, at the same time, we also have to face the challenge which brings
to the traditional economic. China's merce has experienced only a short
period of time of less than 10 years, but it has made tremendous achievements.
At the same time, there are many problems that urgently need to resolve in the
development, for example, the work criminal acts, the increasing
petition work, how to protect the legitimate rights and interests
of consumers, and work violations, and so on. These are seriously
affected the healthy development of merce, and to some degree affected
the healthy operation of the country's econ
