第一条为加强对本市住宅专项维修资金的管理,保障住宅共用部位、共用设施设备的维修和平安使用,维护住宅专项维修资金所有者的合法权益,根据?中华人民共和国物权法?、?物业管理条例?和?住宅专项维修资金管理方法?〔建设部、财政部165号令〕等有关法律、法规和规章的规定,结合本市实际,制定本方法。 第二条本市行政区域内商品住宅、售后公有住房住宅专项维修资金的交存、使用、管理和监督,适用本方法。 本方法所称住宅专项维修资金,是指专项用于住宅共用部位、共用设施设备保修期满后的维修和更新、改造的资金。 第四条住宅专项维修资金管理实行专户存储、专款专用、所有权人决策、政府监督的原那么。第五条市住房和城乡建设委员会〔市人民政府住房制度改革办公室,以下简称“市住房城乡建设委〞〕负责本市商品住宅和售后公有住房住宅专项维修资金的指导和监督工作。市住房资金管理中心〔以下简称“市资金中心〞〕负责本市住宅专项维修资金的日常管理工作。市财政局、市审计局按照各自职责负责本市代管期间住宅专项维修资金的监督和审计工作。区、县建委〔房管局〕、区、县房改办负责本辖区内商品住宅和售后公有住房住宅专项维修资金的指导和监督工作。第二章交存 第六条以下物业的业主应当按照本方法的规定交存住宅专项维修资金: 〔二〕住宅物业管理区域内的非住宅或者住宅物业管理区域外与单幢住宅结构相连的非住宅。 前款所列物业属于出售公有住房的,售房单位应当按照本方法的规定交存住宅专项维修资金。第七条商品住宅的业主、非住宅的业主按照所拥有物业的建筑面积交存住宅专项维修资金,每平方米建筑面积交存首期住宅专项维修资金的标准为:多层〔单体建筑地上结构最高层数为六层或六层以下的〕为100元/建筑平方米;高层〔单体建筑地上结构最高层数为六层以上的〕为200元/建筑平方米。市住房城乡建设委根据本市住宅建筑安装工程每平方米造价的变化情况,适时调整首期住宅专项维修资金的交存标准。 第八条出售公有住房的,按照以下规定交存住宅专项维修资金: 〔一〕业主按照所拥有物业的建筑面积交存住宅专项维修资金,每平方米建筑面积交存首期住宅专项维修资金的数额为本市房改本钱价的2%。 〔二〕售房单位按照多层住宅售房款的20%、高层住宅售房款的30%,从售房款中一次性提取住宅专项维修资金。第九条业主交存的住宅专项维修资金属于业主所有。 从公有住房售房款中提取的住宅专项维修资金属于公有住房售房单位所有。 第十一条业主大会成立前,已售公有住房住宅专项维修资金,由市资金中心负责日常管理。市资金管理中心应当委托本市一家商业银行,作为售后公有住房住宅专项维修资金的专户管理银行,并在专户管理银行开立售后公有住房住宅专项维修资金专户。开立售后公有住房住宅专项维修资金专户,应当按照售房单位设账,按幢设分账;其中,业主交存的住宅专项维修资金,按房屋户门号设分户账。 第十二条商品住宅的业主应当在办理房屋入住手续前,将首期住宅专项维修资金存入住宅专项维修资金专户。已售公有住房的业主及售房单位应当在办理权属登记手续前,将首期住宅专项维修资金交由售房单位存入售后公有住房住宅专项维修资金专户。公有住房售房单位应当在收到售房款之日起30日内,将提取的住宅专项维修资金存入公有住房住宅专项维修资金专户。severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured16severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured5severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured第十三条商品住宅购置人未按本方法规定交存首期住宅专项维修资金的,建设单位不得将房屋交付购置人;已售公有住房未按本方法规定交存首期住宅专项维修资金的,房屋登记部门不予办理房屋产权登记手续。第十四条专户管理银行、代收住宅专项维修资金的售房单位应当出具由市财政局统一监制的北京市住宅专项维修资金专用票据。第十五条经业主大会决议,业主委员会可以在市住房城乡建设委通过招标方式确定的商业银行,开立本物业管理区域的住宅专项维修资金专户,并向市资金中心申请划转本物业管理区域业主交存的住宅专项维修资金。市资金中心应当在收到申请之日起30日内,将该物业管理区域内业主交存的住宅专项维修资金账面余额划转至业主大会开立的住宅专项维修资金账户,并将有关账目等移交业主委员会。划转住宅专项维修资金时,业主委员会应当与开户银行、区县建委〔房管局〕签订发生危及房屋平安等紧急情况时,同意区县建委〔房管局〕组织代修并支付费用的授权协议书。第十六条开立业主委员会住宅专项维修资金专户,应当以物业管理区域为单位设账,按房屋户门号设分户账。业主委员会住宅专项维修资金专户应当使用信汇凭证或电汇凭证结算,不得支取现金,不得使用其他票据或者结算凭证。用于支付维修severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured6severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured17severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured及更新、改造工程费用的住宅专项维修资金只能支付到已在银行备案的施工单位或物业效劳企业账户中。住宅专项维修资金划转后的账目管理单位,由业主大会决定,业主大会应当建立住宅专项维修资金管理制度。?第十七条业主大会开立的住宅专项维修资金账户,应当接受所在区、县建委〔房管局〕的监督。业主委员会开户后不得擅自变更开户行。确需变更的,应当经业主大会决议通过,并按照首次开户方法重新开立住宅专项维修资金账户。开立住宅专项维修资金账户时,业主委员会不得借机向开户行索取任何好处。开户银行应当严格自律,禁止为业主委员会提供物品、费用和协议范围以外的效劳,禁止采取任何不正当的营销手段。如开户银行违规操作,一经查实,将取消其受托资格,并依据治理商业***的有关规定进行处理。业主大会、业主委员会只能委托开户银行购置一级市场国债,禁止进行任何有风险的理财或投资,以确保住宅专项维修资金账户内的资金平安和及时支取。第十八条业主分户账面住宅专项维修资金余额〔不包含公有住房售房单位交存局部〕缺乏首期交存额30%的,应当及时续交。severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured16severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured7severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured专户管理银行或开户银行应当及时向分户账面余额缺乏首期交存额30%的业主发出续交通知。业主应当在接到续交通知之日起30日内,将续交的住宅专项维修资金存储到专户管理银行或开户银行。 成立业主大会的,住宅专项维修资金的续交方案应当在?管理规约?中予以明确;未成立业主大会的,业主续交后的分户账面余额不得低于首期交存的额度。第十九条本方法实施前,商品住宅、已售公有住房未建立住宅专项维修资金的,应当按照本方法规定的交存标准、交存方案进行补建。业主未按规定补建、续交住宅专项维修资金的,业主委员会应当催促其交纳,也可以依据?管理规约?向人民法院提起诉讼。第三章使用 第二十条住宅专项维修资金应当专项用于住宅共用部位、共用设施设备保修期满后的维修和更新、改造,不得挪作他用。第二十一条住宅共用部位的维修和更新、改造范围包括:〔一〕屋面防水层破损,顶层房间渗漏的;〔二〕楼房外墙出现雨水渗漏,引起外墙内外表浸湿;〔三〕地下室出现渗漏、积水的;severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured8severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured17severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodebitatmeasurementlevelpointsgriderrors,omethylverticalboxcenterlinedistancefora,,tobverticalboxdistanceforb,listcanmeasured〔四〕楼房外墙外装饰层出现裂缝、脱落或空鼓率超过国家相应标准、标准的规定值;〔五〕建筑保温层出现破损或脱落,或建筑保温不良引起外墙内外表出现潮湿、结露、结霜或霉变;〔六〕外墙及楼梯间、公共走廊涂饰层出现开裂、锈渍、起泡、翘皮、脱落、污染的;〔七〕公用区域窗台、门廊挑檐、楼梯踏步及扶手、维护墙、院门等出现破损的;〔八〕公共区域门窗或窗纱普遍破损的。第二十二条住宅共用设施设备的维修和更新、改造范围包括:〔一〕电梯主要部件需要进行维修或更换的;〔二〕二次供水系统设备部件磨损、锈蚀严重的;〔三〕避雷设施不满足平安要求的;〔四〕配电设备局部电缆、电线、配电箱〔柜〕内元件损坏的;〔五〕消防系统出现功能障碍,或局部设备、部件损坏严重的;〔六〕楼内排水〔排污〕设备出现故障,给、排水管道漏水、锈蚀严重、排污泵锈蚀或其他设备损坏的。第二十三条住宅专项维修资金的使用,应当遵循方便快捷、公开透明、受益人和负担人相一致的原那么。severalgroupnumber,thenwithb±a,=c,-2~3measurement,suchasproceedsofcvaluesareequalandequaltothedesignvalue,,b,andcvalueswhileonhorizontalverticalerrorsformeasurement,Generalinironanglecodeb
