第一节国际防止船舶造成污染公约
一、公约产生的历史背景
1. 1967年TORRY CANYON号在英吉利海峡触礁,,引发了世界第一次大规模海上溢油惨祸,使英法两国遭受巨大经济损失。
2. 1954年在伦敦制定了“1954年国际防止海洋油污染公约”,。此公约主要强调在公约所规定的沿岸水域范围内禁止排放石油和油水混合物,其认为100ppm以下的油水混合物对海洋环境不会造成污染。
3. 现代工业飞速发展,各种污染物激增,54公约已过时。1973年IMO在伦敦制定了第一个具有普遍意义的《1973年国际防止船舶造成污染公约》,简称MARPOL73公约。该公约迟迟没能生效,IMO于1978年2月通过了《1973年国际防止船舶造成污染公约》的1978年议定书,对73公约作了许多修正,并补充了许多内容。因此通常将经1978年议定书修正的1973年国际防止船舶造成污染公约称为《73/78防污公约》(MARPOL73/78)

5. 现在MARPOL73/78公约共有20条,另附有两个议定书、六个附则。

附则Ⅳ:防止船舶生活污水污染规则
附则V: 防止船舶垃圾污染规则
附则Ⅵ:防止船舶造成大气污染规则
其中附则III、IV、V、VI为可选附则

二、议定书
议定书I:关于涉及有害物质事故报告的规定
Article Ⅰ、报告的责任(Duty to report):事故时,船长或相关人员应毫不迟疑地按议定书的规定,对事故详细报告。
Article Ⅱ、报告的时间(When to make reports):
为保障船舶安全或救助海上人命,向海上排放或可能排放油类或有毒液体物质时;排放或可能排放海运包装的有害物质时;航行时油类或有毒液体物质的排放超出公约允许的总量或瞬间排放率时。
Article Ⅲ、报告的内容(Contents of Report):船舶的特征;事故发生的时间、种类及地理位置;有害物质的数量及类别;援助和救助的措施。
