阐述了破坏环境资源保护罪刑罚设置的弊端;论述了破坏环境资源保护罪配置资格刑的必要性;认为要完善破坏环境资源保护罪刑罚, 就要将剥夺政治权利资格刑扩展到破坏环境资源保护罪, 增设禁止从事特定职业或活动的资格刑, 增设单位破坏环境资源保护罪的资格刑类型。

Abstract:
The disadvantages of setting up the crime of destruction of environmental resources protection were necessity of the construction of the qualification penalty for crime of destruction of environmental resources protection was improve the environmental resources crime penalty, it is necessary to extend the qualification penalty of depriving the political rights to the crime of destruction of environmental resources protection, to create the qualification penalty of prohibit from engaging in a particular occupation or activity, and to construct the qualification penalty type for crime of destruction of environmental resources protection anization.

破坏环境资源保护罪(以下简称“环境资源犯罪”) 主要是指在生产、生活活动中过量地向自然界
