Confirmation as a process from evidence to conclusion, the procedure should have strict legal and logical security. Standard of proof in traditional theory of proof has its paradox and lead to poor operational; it will affect the trial's fairness and efficiency. The introduction of probability point of view can be in form, in essence, to resolve the problem in thinking process can not be tested in practice.
Confirmation logic mainly studies the relationship between evidence and assumptions. With the development of probability reasoning, the confirmation system es maturing and perfect. The process from evidence to the assumption is a travel from individual to general. In this sense, the conclusion of
confirmation logic is contingent,it can be expressed in the form of probability.
Confirmation is the activities which certify the capacity and effectiveness of the evidence. The judiciary in particular, the judge or jury makes conclusions based on evidence and the causal link and probability in evidence and conclusions. Therefore, the proposed confirmation standards and norms in the implementation of very important significance, it is the minimum standards of making a conclusion, that is, at least the possibility of one of the parties’ establishment is greater than the other side, and up to the required absolute standard.
From a logical perspective to address the issue of standards of proof so that
probability es the ultimate expression of conclusion, quantified in litigation proved is achievable. In this paper, introduces the standard of proof such as "a high degree of probability" and "beyond reasonable doubt", increases enforceability of the trial so that the activities of the proceedings in a fair and effective unified.
