名人有种可怕的知名度，一方面能借此获得巨额收益，另一方面却激起了媒体越来越疯狂的窥视。欧文·华莱士甚至还写了一本名叫《名人隐私录》的书，彻底揭露名人不为人知的另一面。虽然名人在社会单元中具有一定的特殊性，但他们也有隐私权，理应受到法律保护。下面我们不妨来分析一下名人隐私及其保护的问题。
一、隐私权与知情权的矛盾冲突
隐私权，就是个人有依照法律规定保护自己的隐私不受侵害的权利。知情权是指公民有权知道他应该知道的事情，国家应最大限度地确认和保障公民知悉、获取信息的权利，尤其是政务信息的权利。 那么谁算是名人呢?简单的说，就是明星、政要高官、社会名流，还有一部分与上述人群有瓜葛并对媒体公开他们之间私密关系而窜红的人，另外就是进行反道德反人类活动的社会公敌(如萨达姆)。 尽管每个人都有隐私不宜曝光，但有些事情是需要报道来进行社会监督的。这里特别指政府部门的。例如，公民有知情权，他们有权知道选举对象的家庭情况，个人履历，这就不属于侵权行为;新闻媒体对个别贪污受贿、结党营私的劣行予以曝光，正体现了“无冕之王”的社会价值;机关、整理档案人员在获得相关批准后也有权知晓别人的个人信息，这种权限是受到法律保护的。所以知情权是建立在法律支持的基础上，知晓与社会公众利益顶伐侈和侬古畴汰川咯息息相关的人物、事物的信息。既然有知情权，那么媒体对名人的报道是不是就不用受到法律的限制呢? 答案当然是否定的。因为隐私是与社会生活无关的、当事人并不愿意公开的私事，既然与社会生活无关，那么就不在知情权的行使范围之内。不能以知情权作为理由就随意侵害名人的隐私权，更不能为了个人的经济利益而出卖名人的隐私。
二、隐私的被动性和主动性
分析了一些名人隐私权被侵害的案例，我们可以看出隐私也有被动和主动之分。
隐私的被动性在于，名人的举手投足都具有被报道的价值和社会需求，而媒体为了自身发展也需要挖掘名人隐私去吸引大众的眼球。于是无论名人走到何处，总会有媒体尾随，他们生活中点点滴滴的小事，都会被媒体当作新闻给报道出来。甚至媒体会花巨资购买名人隐私消息，比如，《star》杂志悬赏500万美金征集好莱坞明星汤姆克鲁斯的新生女儿苏利的照片。揭穿名人隐私给媒体带来的巨大经济回报让各家媒体为了抢头条挤破了头，纷纷采用各种录影录音设备对名人的私宅进行24小时的监控，还特派狗仔队紧紧盯住名人不放。媒体这样的狂轰滥炸，对于名人来说，自然是防不胜防。不然，怎么会发生TWINS组合成员阿娇在换衣间被人偷拍的事情呢?由此才引发香港演艺人协会的愤然声讨《壹周刊》事件。 隐私同样具有主动性。名人是需要有一定的曝光度来维系人气的。他们相对于普通人来说隐私比较少，除了媒体的报道之外，他们自己也要通过接受人物专访、出书等形式公布自己的隐私。现在很流行名人博客，其中最典型的代表就是徐静蕾的“老徐的博客”。目前，她博客的点击量已经达到9163万，里面也无非是公布她近期的行程以及生活中的小感悟。最近网络上出现了一幅徐静蕾的画，还大肆拍卖，一时间老徐博客上传出沸沸扬扬的争论之声。所以名人与媒体之间的关系很复杂，有合作也有矛盾的一面。
三、越演越烈的侵权事件
英国《卫报》曾刊登出一篇文章，对足球明星贝克汉姆性丑闻事件做了一次民意调查，其中绝大多数人赞成出台保护名人隐私不被曝光的法律。
在自媒体时代，名人们几乎失去了自己私生活的空间，毫无隐私可言。每每有名人婚姻触礁，很快便会被媒体曝光。公众的各种议论也接踵而至，充斥网络。在王石与田朴珺之前，媒体对王菲与李亚鹏离婚的新闻也是开足了马力，说挖地三尺并不为过，生怕漏掉一点点细节。“圈内人”的说法，小孩的归谁，财产归属，甚至连王菲与李亚鹏返回北京乘坐的航班，王菲与李亚鹏离婚后的特殊表情，都成了媒体竞相追逐的焦点。中“专业化、现代化”程度，丝毫不逊色于国外的狗仔们。有一家媒体甚至上演生死时速，将王菲的车截停在高速公路上，为的就是拍到一张王菲在车内流泪的独家照片，遭到公众的强烈谴责。
是的，名人不同于普通人，名人的婚姻受到公众的关注很正常。现在的问题是，公众的这种关注得有分寸，千万不要越界。过度的关注，甚至指手画脚，就有绑架名人婚姻、干涉名人私生活之嫌。
公众对名人婚姻的过分关注，多半是因为婚姻中一方甚至双方是自己的偶像。婚姻变卦，偶像受伤，粉丝之间必然开战。妄下结论的有之，道德卫士更多。他们要么同情婚变中的一方，胡乱指责谁谁谁不道德，谁谁谁没良心。这恐怕还是因为很多人对“婚姻自由”的理解存在认识上的误区。《婚姻法》明确规定，公民有结婚的自由，也有离婚的自由。名人作为一个公民，他们的婚姻同样应该受到《婚姻法》的保护，他们理应享受婚姻自由。
诚然，名人应该自觉承担更多的社会责任，自觉维护自身的形象。但要求所有名人成为“全国道德楷模范”然不现实。名人说到底也是人，他们也要过正常人得生活。他们的婚姻和普通人的婚姻一样，同样也会遭遇“七年之痒”，甚至走向陌路。

It is not difficult to explain the reason for the reporters’ great interest in celebrities’ private lives. What matters to a newspaper or a magazine is the number of readers. A large readership means the rise in the circulation of their publications, hence a huge profit. Since celebrities are newsworthy figures, and their stories draw far more attention than those of ordinary people, it is natural that the press tries to feature private lives of celebrities.
