一、课程目的与要求
通过本课程的学****使学生掌握土地法学的基本原理和土地执法的基本知识,培养学生执法和从事土地监察的能力,能独立处理土地违法案件,调处土地纠纷,从事土地行政复议工作,参预土地行政诉讼等活动。
二、课程简介:
土地法是国家制定的关于调整人们因占有、使用、利用土地而发生的各种土地关系的法律规范的总称。土地法学是以我国现行的土地政策,法律为依据,研究土地法律规范的制定,遵守和执行等方面的理论和实践问题,是法律理论和法律实践相结合的实用课程,是土地资源管理专业的主干课。
其内容可分为三个部分。第一部分:土地法学基础理论。包括土地法学研究对象和内容体系,土地法律关系,土地所有权和土地使用权、土地相邻关系等;第二部分:土地利用法律制度。包括耕地保护法律制度、建设用地法律制度和国有土地有偿使用法律制度;第三部分:土地行政法。包括土地行政执法和土地监察、法律责任、土地行政复议、土地行政诉讼等。

Land law is a general law standard system which is enforced by states to adjust all sorts of land relations occurred during the processes of occupation, use and utilization. Land law theory is based on land policy and law acting in present. It involves the questions of theories and practices during the land law standard legislation, observance and execution. It is a main course for students whose major are land resources management.
Land law theory contents three parts. The first is basic theory of land law theory including the object researched, content system, land law relation, land proprietary and access, land adjoin relation, and so on. The second part is the utilization system which contents cultivated land protection institution, constructive utilization institution, and state-owned pensable utilization institution.
