摘要
产品责任归责原则是产品责任的核心内容,历来是法学界争议的焦点,在我国的立法中对产品责任归责原则的规定呈现出法律之间的冲突。确定一个合理的产品责任归责原则在处理缺陷产品引起的纠纷中起着关键的作用。随着缺陷产品的存在使得产品侵权事件不断增加,世界许多其他国家在该领域对产品责任归责原则有了较为统一的认识,但在我国,由于立法的不完善,法学界不同学者对产品责任归责原则的理解有着各自不同的理解,不利于缺陷产品纠纷的解决及法价值的实现。本文从我国国情出发,就产品责任归责原则的适用做了简单论述,并提出一些改善意见。

Abstract
Product liability principle of tort liabilities is the core content of the product liability has always been the focus of controversy of jurisprudence, showing a legal conflict between the provisions of the Product Liability principles in the legislation of our country. Determine a reasonable Product Liability principle in dealing with disputes caused due to defective products play a key role.
