摘要
众所周知,钓鱼岛自古以来就是中国不可分割的领土。钓鱼岛在经济、资源利用与军事国防安全方面对中日双方都具有极其重要的地位。在钓鱼岛的主权问题上,中日双方存在较大的争议。本文通过阐述钓鱼岛的地理位置与历史背景,以及从国际法的角度分析钓鱼岛特殊的法律地位及主权归属,其中主要在国际法中的先占问题与国际条约方面重点分析,进一步证明钓鱼岛是中国固有的领土。

ABSTRACT
As we all know, the Diaoyu Islands is inalienable part of China since ancient times. Diaoyu Islands in the economic, national security and military use of resources in terms of both China and Japan have an extremely important sovereignty of the Diaoyu Islands issue, China and Japan there is a big paper explains the historical background, geographic location and the Diaoyu Islands, and the Diaoyu Islands from the perspective of international law, the special legal status and sovereignty,mainly accounted for in the first issue of international law and international treaties analyzed,further evidence of the Diaoyu Islands are China's inherent territory.
