一、定义
海运提单是由船长或承运人或其代理人签发的,用来证明海上运输合同和货物由承运人接管或装船,以及承运人保证据以交付货物的单证。
提单中载明的向记名人交付货物,或者按照指示人的指示交付货物,或者向提单持有人交付货物的条款,构成承运人据以交付货物的凭证。

Article 20 Bill of Lading
a. A bill of lading, however named, must appear to:
i. indicate the name of the carrier and be signed by:
• the carrier or a named agent for or on behalf of the carrier, or
• the master or a named agent for or on behalf of the master.
Any signature by the carrier, master or agent must be identified as that of the carrier, master or agent.
Any signature by an agent must indicate whether the agent has signed for or on behalf of the carrier or for or on behalf of the master.

(一)从法律角度看,提单的基本作用为

(二)从外贸业务和运输业务角度看
承运人有条件地为托运人运输货物的书面证明。
是银行结汇文件中最重要的文件。
是货主和货代之间,货代和承运人之间支付和收取运费的凭证。
向船公司和保险公司索赔的重要依据。
