上海水务行政执法研究

摘要

水资源是人类最重要的自然资源之一,是社会经济赖以生存和发展
的基本条件。但在我们跨进 21 世纪后,全球范围的缺水危机正以空前的
速度扩散,水资源匮乏、水环境恶化、水管理紊乱日益引起人们的重视。
上海,得益于丰富的过境水资源而成为全国水资源人均拥有量最高的城
市之一。但随着社会经济的迅速发展对水资源的需求增加和疏于保护水
环境,上海已沦为水质型缺水城市之一。严峻的事实引起了上海市政府
的思考,经过周密论证,上海于 2000 年 5 月在全国省级政府中率先组建
了水务局,统一行使上海淡水资源的行政管理权。
在行政执法上,上海市水务局成立六年来,对水务一体化执法进行
了不懈地探索。本文在研究分析上海水务行政执法实践的基础上,以公
共管理理论为指导,剖析了其进步意义与存在的不足,并提出了近期完
善的措施。作者认为,推进依法治水,落实水务行政执法责任制,确保
严格执法、公正执法、文明执法,当务之急一要进一步加强水务行政处
罚权的相对集中,二要加强水务行政队伍建设,三要严格水务行政执法
程序,四要加强水务案件审理中的民主建设, 五要特别注意尊重人性尊
严原则、平等原则和比例原则,六要鼓励公众参与水务行政执法,七要
切实完善水务行政执法绩效管理,八要加强对水务行政执法的监督。

目前,已经有很多城市开始实施水务一体化管理,希望本文的研究
成果能为深化水务行政执法的改革起到抛砖引玉的作用。

STUDY ON ADMINISTRATIVE
ENFORCEMENT OF WATER LAW
IN SHANGHAI

ABSTRACT

Water is one of the most important natural resources to human beings and
it is the basic condition on which the social economy depends to survive and
develop. However, when we step into the 21th century, the worldwide water
crisis is spreading at a unprecedented speed. The lack of water, the
deterioration of the water environment, the disorder of the management of
water, all the things are attached more and more importance to by people.
Shanghai, thanks to the abundant water resources passing through the territory
of the city, has e one of the cities which owns the highest average per
capita availability of water resources. But with the rapid development of
economy, the increase in the need for water resources and the neglect of
protecting the water environment, Shanghai has e a city lacking water
