房产交易纠纷引发的群体突发事件应急管理研究

摘要
本文认为,房产交易纠纷引发的群体突发事件是指由于房产交易
当事人在交易过程中发生纠纷,利益受损的一方未经主管机关许可,
组织一定数量当事人突然采取围堵党政机关、静坐请愿、阻塞交通、
集会、聚众闹事、群体上访等行为,并对政府管理和社会秩序造成一
定影响的突发事件;其类型主要有房屋交付质量与承诺不符、房产价
格大幅下跌、期房建设项目停工、房产中介侵占客户资金、规划设计
变更等;此类事件具有涉及人数众多、主体构成多元,涉及利益巨大、
处置难度很大,行为方式激烈、持续时间较长,目标高度一致、组织
化程度高等特征。根据社会燃烧理论,房产交易纠纷引发的群体突发
事件呈现出“潜在—酝酿—积聚—燃烧—爆发—平息”的这样一个演
进过程。此类事件近两年来有继续上升的趋势,但通过加强市场监管、
改进房产交易政策能够得以有效控制。通过对房产交易纠纷引发的群
体突发事件的现实案例和常规处理流程进行分析,可以看到,我国对
该类群体突发事件的应急管理仍然存在缺少风险意识、缺少预警预
防、缺少应急计划、缺少信息管理、缺少社会参与、缺少表达渠道、
缺少救助手段、缺少形象重塑等突出问题,其原因主要在于中国社会
体制转轨带来利益失衡、政策调整相对滞后、法治社会尚未形成、社
会发育还未成熟。根据公共危机治理理论,借鉴美国的有关经验,本
文提出应通过建立健全政策网络和治理网络来构建对中国社会转型
期房产交易纠纷引发的群体突发事件的治理体系。

A RESEARCH ON CRISIS MANAGEMENT OF COLLECTIVE
CONFLICTS CAUSED BY REAL ESTATE TRANSACTION

ABSTRACT

This thesis holds that the collective conflicts arising from the real
estate transactions refer to the unexpected events caused by the dispute in
the trading process of the parties. Without the permit of the
authority-in-charge, the aggrieved anizes a certain number of
involved persons to take the sudden actions such as the containment of
the party and ans, the sit-petition, blocking the traffic,
assembly, mob, and mass petition which impact the government
management and social order to some extent. The main types are housing
delivery quality does not match mitment, real estate prices have
fallen substantially, the construction projects of the forward delivery
housing has been suspended, the real estate intermediaries occupy
customers capital. All these accidents show the characteristic which are
large number of multi-position, involving the huge interests,
very difficult to dispose of, intense conduct, longer duration, highly
