不能被现代法权系统承认。各国安乐死立法主要体现了第二种安乐死合法性。第一种安乐死合法性容易被遗忘和忽视;
第二种安乐死合法性目前遭到了广泛的误解:第三种安乐死合法性则是误解的产物并且超出了法律的维度。

【Abstract】It is necessary to precondition the study of legality to legitimization in Euthanasia’S the log—
ical way,there are three probable connotations in the study of Euthanasia legality:Euthanasia does not transgress;practic—
ing euthanasia in accordance with law;Euthanasia is a right. I e paper points out the first and third kind of connotations
have not been acknowledged by the modem legal right system. I e legislations of Euthanasia in the wodd are the embodi—
ment of the second kind of connotation. Meanwhile, the first kind of connotation is buried in oblivion. And the second
kind sufers wide third kind of study has been e the ofspring of misinterpretation beyond the
legal dimensionality. I e paper distinguishes itself the three probable study ways in legality of Euthanasia from the cur—
rently confused researches.

、安乐死“合法性”的界定
“合法性”是一个容易遭到滥用的概念。我们可
以通过以下步骤厘清其基本涵义。首先,要区分“合
法”概念有两个使用领域。一种是在政治哲学或社
会理论等领域。此时的“合法”主要涉及统治正当性
问题。如马克斯·韦伯的合法化研究和哈贝马斯的
晚期资本主义“合法化危机”分析。“合法”的另一种
用法则局限于法律范围,仅涉及对行动或规定的法
律评价问题。哈贝马斯经常使用的legitimit~it和le—
galitat两个概念都可以译为合法性,但legitimit~it可
以将法律本身也作为评价对象,legalitat的意思则仅
限于以现行法律为标准来衡量一个规定或一个行
为。①这两个词分别对应于英语中的legitimate和
legal。很明显,legalitat和legal才是安乐死法律问题
涉及的合法概念。也就是说,“安乐死合法性”并不
涉及统治正当性的评价问题,只涉及法律评价问题。
其次,“合法”概念既包括“符合法律规定”,也包括
“不违反法律”。“合法”、“合法的”与“合法性”三个
概念是紧密相关的。前两个概念是理解合法性的前
提。当我们对一种行为做出“合法”或“是合法的”的
评价时,这一行为便具有了“合法性”。《现代汉语词
