医务人员因未履行告知义务,致孕妇产下先天残障儿构成不当出生,侵害不当出生残障孩子父母的优生优育的选择权。不当出生不但造成父母抚养一个残障孩子比一个正常、健康的孩子更多的经济负担,而且给其精神造成巨大的痛苦,对此,医疗机构应对其未能正确履行告知义务导致不当出生而应承担相应的赔偿责任。我国司法理论界及司法实务普遍认为不当出生可适用侵权责任法以维护当事人的合法权益,同时,一般认为不当出生侵害了当事人的自主生育的选择权,自主生育权属于人身自由权内容之一,理应受法律保护。对此, 本文通过分析不当出生请求权的理论基础,确定不当出生的责任主体赔偿依据、赔偿范围及不当出生的请求权人的范围。近些年,我国陆续出现不当出生案例, 因现行法律对此无明确规定,各地法院的判决结果不尽相同,故对不当出生责任的研究,对处理此类案件具有重大的现实意义。
本文通过对一个典型的不当出生案例介绍及评析,引发对不当出生存在的问题及法律思考。阐述了不当出生的含义及其历史发展经历,从违约、侵权两个不同角度分析不当出生的请求权基础,提出不当出生应以侵权作为请求权基础更为合理。分析了不当出生的侵权构成要件,提出过失医疗行为的判断标准, 这有助于判断出生先天缺陷的婴儿是否构成不当出生。针对我国不当出生制度的不完善,就主体适格问题、赔偿范围的确定、权利适当限制等方面提出几点建议,以期对构建科学、合理的不当出生制度有益的补充。

Is generally believed that the wrongful birth tort law applies to safeguard their legitimate rights and interests of justice theory and the judicial practice, but generally, wrongful birth on the reproductive choices of autonomous, independent elements of reproductive rights are personal rights, shall be protected by law. In this regard, analysis of thewrongful birth claim theory, mainly responsible for determining pensation for wrongful birth according to the scope, compensation and claim of wrongful birth. In recent years, Chinese has a wrongful birthcase, because of the lack of legal definition, a local court verdict isdifferent, so the treatment of such cases of wrongful birth investigationresponsibility is of great practical significance.
In this paper, through the analysis of typical cases of wrongful birth,wrongful birth
