摘要
禁止滥用市场支配地位制度是反垄断法的三大支柱之一,对于市场竞争秩序具有举足轻重的作用。为了防止企业滥用市场支配地位,应对滥用市场支配地位的行为进行规制,以维持合理的市场结构,维护公平竞争,保护竞争者的合法权益,促进和保障市场经济健康发展。
本文分成四个部分,首先从滥用市场支配地位的行为的概述出发,具体对滥用市场支配地位的概念、特征以及具体行为类型做详细梳理。其次,相关市场的界定是进一步讨论滥用市场支配地位的前提与基础,本部分对相关市场的概念和相关市场的理论划分作出了分析。再次是对市场支配地位界定进行深入的研究,本部分对市场支配地位的概念和认定企业拥有市场支配地位的标准进行探讨,同时结合我国《反垄断法》,对市场支配地位的认定标准作出了更进一步的分析。最后是对滥用行为的认定进行阐述,对构成滥用行为的具体要件和对认定滥用市场支配地位的基本原则——本身违法原则和合理原则进行了阐述。

Abstract
Banning the abuse of dominant station is one of the three pillars of the antitrust laws. It plays an important role in upholding the order of petition .In order to prevent the enterprises from abusing dominant station , antitrust laws must regulate the conduct of the abuse of station. Thus the law can maintain reasonable market structure, safeguard petition , protect the legal rights of petitors, and promote the healthy development of the market economy.
This article is divided into four parts. Part one, I mainly tells the story of abuse of a dominant position of the specific behavior concept, features and types. Part two, I will make analysis about the concept of relevant market and related market theory.
