超标排污的法律规制研究

从 1979 年《环境保护法》颁布以来,超标排污的法律规制渐成体系,产生了良好的社会效益。但是随着社会经济的发展,超标排污现象有增无减,也说明超标排污的法律规制依然存在不足和问题。在三十余年的施行过程中,伴随着各环境保护单行法律法规的制定与修改,可以在实践中发现很多超标排污法律规制措施存在着执法力度轻微的弊端,法律法规之间也存在着缺乏衔接性的问题,不同规制措施之间有着许多不利于执行和认知的杂乱之处。
本文针对上述问题,首先对超标排污法律规制的基本理论进行阐述,对相关概念进行界定和辨析,阐明了超标排污法律规制的概念,并分析了超标排污法律规制的特点,也探讨了超标排污法律规制的现状。其次,从处罚力度轻微、信息公开欠缺以及适用条件混乱三个方面分析超标排污法律规制的不足。最后,从一个宏观角度,探讨各处罚之间的相互衔接,以期能够对超标排污行为起到较良好的法律规制;并探究在制定各超标排污法律规制措施时进行体系化设置,以节约行政机关的执法成本,也更利于公众和企业了解和遵守。

The Research on Legal Regulations of Excessive Discharge Abstract
Since 1979 when the Environment Protection Law was promulgated, the system of legal regulations of excessive discharge was built. And that also brought good social benefits. With the development of society and economy, the excessive discharge increased but decreased. This means there are still lots of problems in the existing law and regulations. During enacting the law for more than 30 years lots of specific environmental laws and regulations have been legislated and modified. From the practice, we could see some negative effect in the lay enforcement. And there is a lacking of relevant in different laws and regulations, also misunderstand for the people who use the law.
Concerning above problems, this paper will explain the basic theories and concept of legal regulations about excessive discharge, and also explains the difference of related concepts. Besides, some researches on the features of excessive discharge and current situation have been done. Secondly, this paper will analysis the shortage of the law and regulations from three respects: slight punishment, lack of information disclosure, and disordered applicable conditions. Lastly, hope to regulate the excessive discharge by discussing the connection of punishments macroscopically. On the other hand to make the
