【ABSTRACT】This article propose that our government should have an active attitude towards world anization agreement on government procurement and perfect our public procurement system, and even enter into world anization agreement on government procurement at a proper time through the brief introduction about world anization agreement on government procurement and the present condition of Chinese public procurement.

政府采购的定义和特征
政府采购(Government Procurement), 也称公共采购(Public Procurement),是指公共部门为了开展日常政务活动或为公众提供公共服务的需要,在财政的监督下,以法定的方式、方法和程序(按国际规定一般应以竞争性招标采购为主要方式),利用国家财政性资金和政府借款,从市场上为政府部门或所属公共部门购买商品、工程及服务的行为。
通过比较世界贸易组织的《政府采购协议》(The Agreement on Public Procurement),联合国贸易法委员会(UNCITRAL)的《货物、工程和服务采购示范法》和还有欧盟(EU)《政府采购指令》(Purchasing Directives ),概括而言,政府采购应该有以下特征。
1. 采购主体具有特定性。政府采购的主体,也被称作政府采购的实体,指的是依靠国家财政资金运作的政府机关,事业单位和社会团体以及公共事业机构等。世界贸易组织《政府采购协议》(The Agreement on Public Procurement)中规定:采购实体为一国政府部门、机构或它们的代理机构。各国在加入《政府采购协议》时应该提交一份采购实体清单,归入《政府采购协议》的附录1中。只有列入清单的实体才受《政府采购协议》约束,名单以外的其他政府部门的采购和地方政府的采购则不受约束。
2. 采购对象具有广泛性。采购的对象并不局限于货物,还有工程和服务,货物又包括有形产品和无形产品,标准产品和非标准产品,既有军用品又有民用品。
