担保物权的善意取得是以担保物权为客体的善意取得制度,是指占有人以他
人的财产为债权设定担保,在债务人不履行债务的情况下,善意的担保物权人有
权处分该财产,以获得优先受偿的制度。担保物权善意取得制度的理论基础是物
权的公信力,善意第三人基于对物的公信力的信赖而进行交易,其利益应得到维
护。担保物权善意取得制度的确立,不仅有利于维护市场交易安全,有利于充分
发挥物的经济效用,而且其对善意受让人的保护实现了利益衡平,体现了法律的
公平理念。
本文以我国现今法律中有关担保物权善意取得制度的规定为基础,先对担保
物权的善意取得制度作了整体上的阐述,然后对三种担保物权即抵押权、质权、
留置权的善意取得分别进行了系统的研究和分析,主要解决能否适用善意取得以
及如何适用善意取得这两个方面的问题。由于各个担保物权有其自身特点,因此
要根据具体情况具体分析,不能一概而论,有些可以适用善意取得,有些则不能。
关于担保物权如何适用善意取得,文中列出了相应的构成要件,其中对如何判断
第三人为善意这一要件作了比较深入的分析。在进行理论分析的同时,笔者也结
合在实践中遇到的关于担保物权善意取得的问题作了分析。

Abstract
Bona Fide Acquisition of security interests is a system whose object is security
interests. In this system, the possessor establishes security interests on other’s
property for his debt. When the debtor cannot perform the debt obligation, the owner
of security interests has the right to dispose of the property so as to get the priority
right. The system of bona fide acquisition of security interests bases on the public
confidence of real right. The benefit of third party in good faith, who trades with the
possessor on the belief of public confidence should get protected. The establishment
of Bona Fide Acquisition of security interests will not only help the security of
transactional marketplace, conducive to full use property of the economic utility, and
its implementation in good faith to balance the benefit reflects the concept of legal
fairness.
According to the regulations on Bona Fide Acquisition of security interests in
Chinese law, this article introduces this system as a whole firstly. Then studies and
analyzes Bona Fide Acquisition of mortgage, pledge and lien. The aim is to solve two
problems: whether Bona Fide Acquisition can be applied or not and how to apply it.
Each security interest is special, so we need analyze specific circumstances. This
article lists ponent parts of Bona Fide Acquisition of security interests. Among
them, the judgement of good faith of the
