摘要
路产保护是公路路政管理的重要任务之一,也是路政管理学关注的热点问题。路产
保护水平的高低直接关系着我国公路交通能否持续、健康、快速地发展。我国的公路路
产保护工作虽取得明显成效,但深层次的问题尚未根本解决。特别是地震、泥石流、雨
雪冰冻灾害等公路突发事件的发生,对公路路产保护工作提出了更高的要求。如何提高
路产保护水平,更好地应对不断出现的新问题,也成为公路路政管理面临的重要任务。
本文基于以上的理论和现实需要,运用行政管理学、管理学、行政法学、制度经济
学等知识,以公共产品理论、组织结构理论、依法行政理论、公共服务理论、制度变迁
理论作为理论基础,针对我国公路路产保护中存在的问题,结合发达国家公路路产保护
经验,从法律法规、机构设置、职权划分、保护手段、执法人员、经费保障等方面提出
了相应的对策建议。旨在丰富公路路产保护的相关理论,探索路产保护制度的创新之路,
规范路产保护的行政执法,以更好地发挥公路路产在国民经济发展中的作用。
本文采用文献分析法、比较分析法等对我国公路路政管理中的路产保护进行了深入
研究,并得出几点结论:政府主导是提高公路路产保护水平的关键要素;制度创新是提
高公路路产保护水平的重要途径;服务公众是提高公路路产保护水平的根本目的。

Abstract
Road property protection is one of the central tasks of road administration and it is an
important issue of road administration research, the level of road property protection is
directly related to the sustained, healthy and rapid development of transport. Road property
protection in our country achieved remarkable results, but deep-seated problems have not
been revolved. In particular, the occurrence of highway emergencies puts forward higher
requirements for road property protection. How to improve the level of protection of road
property to better respond to the new issues is important task of road administration.
This article is based on the theoretical and practical needs, using the knowledge of
administrative management, management, administrative law and institutional economics to
analysis related issues. And it is on the basis of public goods theory, Organizational structure
theory, the theory of administration by law, public service theory and institutional change
theory. This article points out the problems in the system of road property protection and puts
