摘要:随着经济的不断增长,我国城市化的速度日益加快,城市人口呈迅速增加的态势,因此解决住房问题就成了城市发展的重要任务。在这样的形势下,城镇房地产价格持续飞涨,大批城镇居民买不起合法的商品房,只能依靠非法的“小产权房”解决居住问题。“小产权房”虽然在一定程度上解决了住房问题,但其自身还是存在很多的弊端,为社会的发展带来了不稳定因素。本文就是通过对“小产权房”现状及特点分析,结合其成因、法律性质及利弊关系从根本上提出合理的解决对策。

In such a situation, real estate prices continue to soar town, a large number of urban residents can't afford modity house, can only rely on illegal "small property right" solve live problem. "Although small property right" in the certain degree to solve the housing problem, but there are still a lot of its own ings, for the development of the society brought unstable factors. This paper is to "by small property right" present situation and characteristic analysis, combined with its cause, the legal nature of the advantages and disadvantages and puts forward the reasonable relationship radically solving countermeasures.

一、小产权房的概念
所谓小产权房,是指在农村集体土地上,由享有该土地所有权的乡镇府或村委会单独或联合开发商开发建设住宅,并由乡镇府或村委会制作房屋权属证书向城市居民销售的房屋,但双方约定没有国家的土地使用权证和房屋所有权证,只有村集体发放的房屋所有证明,所以其不具法律效力。
