摘要
盗窃罪是社会危害性大的刑事犯罪,理论上,盗窃罪一直是学者们学术研究的焦点,也
取得了相当丰硕的成果。但无论是理论上,还是在实践中,对诸如盗窃罪的犯罪构成、以及
与相关侵财罪界限等若干问题,仍然有许多值得思考和探究的地方。由此,本文着力以下几
个方面阐析盗窃罪中的相关一些问题:
第一部分,盗窃罪的概述。笔者从四个方面分析盗窃罪的内涵。第一,从社会历史角度
探寻其产生缘由。第二,中国古代盗窃罪的规定演进。第三,
四,国现行刑法关于盗窃罪的规定及释义;
第二部分,盗窃罪犯罪构成的解读。本部分从主体要件、主观要件、客观要
件、客体要件四个方面对盗窃罪构成进行探究。笔者不是笼统的去解析各要件,
而是从司法的实践中的困惑去有针对性的透视问题的本质。如单位盗窃罪,公开
盗窃,非法占有说,视为占有,盗窃虚拟财产。逐一进行解读;
第三部分,盗窃罪的既遂与未遂的问题。盗窃罪的既遂与未遂判断从犯罪对
象的物理属性上把握并赞同通说失控说;
第四部分,对盗窃罪与相关罪的界限进行梳理。与抢夺罪的界限,从人身伤
害性、紧密占有物、瞬间暴力性三个方面进行辨别;与诈骗罪的区别,从瑕疵认
识与欺骗行为的关联性、被害人的财产脱离其控制的时间点、其受害人处分其财物是慨括
处分还是具体处分、被骗者是否有处分权四个角度去甄别;与侵占罪的区分,从财物的
占有关系、非法占有意思产生的时间点、结合常贯观念判断占有、应当注意的疑难问题四个
要点去透视梳理;与贪污罪界限,从两者的主体方面和客观方面的特征去理清判断;与抢
劫罪的区别,从盗窃罪转化为抢劫罪的认定条件进行分析探讨;
第五部分,对盗窃罪的立法建议:明确公开盗窃行为,承认公开盗窃以突破
秘密窃取的困境;建议增设单位盗窃罪;建议明确将虚拟财产纳入盗窃罪的对象;
删除把累犯作为盗窃罪的加重量刑情节的规定。

Theft is criminal social harmfulness, in theory, theft has been the focus
of scholars in academic research, achieve very fruitful results. But neither in
