当今中国农村存在的土地所有权和使用权问题及解决办法
——以湘·常德市鼎城区镇德桥镇刘家桥村为例
摘要
土地是中国农民最为关注的财产,在改革开放三十四年的今天,我们应该如何从农村土地所有权和土地使用权中调动农民的生产积极性,是政府应该关注的一大问题。本文从现今我国农村农民对土地所有权的界定认识模糊、所有权分散、土地使用权中土地流转不正规等主要问题入手,并结合了刘家桥村的实际情况来分析土地所有权和使用权问题。通过研究得出当前在土地制度层面和具体实施阶段存在一些对当前农村经济不利的因素。对此,本文从法律、制度、干部队伍建设等方面提出了一些建设性意见,以更好地规范我国农村集体土地的产权及其健康稳定发展。

Abstract
The land is China's farmers of the most attention property, in reform and opening up of the 34 years today, we should do from the rural land ownership and the land use right of the initiative of the farmers to produce more, is that the government should focus on the big problem. This article from the present rural farmers to the definition of the land ownership understanding fuzzy, ownership decentralization, the land use right of the land circulation of the main problems of informal, bined with the actual situation of the LiuGuQiao village to the analysis of the land ownership and use right problem. Through the research that the current land system level and in the implementation stage of the current rural economy has some negative factors. To this, this article from the legal, institutional, cadres team construction, puts forward some constructive Suggestions to better regulate our country rural collective land property rights and the healthy and stable development.
