在当今世界上,法律职业化几乎成为全球化的趋势。令人欣慰的是,我国的
法治建设正好与这样的世界性潮流同步。1997 年,党的十五大把依法治国正式
确立为党领导人民治国理政的基本方略。经过这十年来的实施依法治国基本方略
的实践,我国在改革司法体制、完善法律监督、实现公正司法、宣传法治理念等
方面,都取得举世瞩目的成绩。党的十七大报告明确提出要坚定不移发展社会主
义民主政治,全面落实依法治国基本方略。如何全面贯彻落实党中央提出的这一
基本方略,是摆在我国法律人面前不容推辞的一项重大任务。
构建和谐社会,必须创新解决社会矛盾的机制体制。司法作为解决社会矛盾
的机制之一无疑是中流砥柱。因为法院是实现社会正义的最后一道屏障。如何充
分有效地发挥司法的功能呢?解决这一问题,必须重视法律职业阶层的建设,通
过完善法律职业阶层的有关制度,最终在中国建立一个强大的法律职业阶层从而
有力推进法治的完全实现是可能的。
毋庸置疑,对我国的法律职业阶层的现状进行研究,尔后针对我国现有的法
律职业制度中存在的一些缺陷与不足之处,提出一些改良措施将会对社会主义法
治建设起到积极的影响。笔者正是基于此目的,运用实证、历史、比较和借鉴的
研究方法比较系统地研究了法律职业阶层制度。
针对当下中国法律职业阶层中存在的问题,笔者怀着“惩前毖后、治病救人”
的宗旨,在参考借鉴国外相关有益经验制度的基础上,提出加强法律信仰、完善
法律职业阶层自治制度、理顺法律职业阶层之间的流动机制和规范法律职业服务
市场等等观点和措施。
总之,本文从理论和实践的角度,从历史的角度,以展望未来的眼光对法律
职业阶层中存在的若干相关问题进行了分析和研究,提出了一些改良措施。笔者
的写作目的不在于得出什么“真知灼见”,而在于运用实证、历史、比较的研究
方法对法律职业阶层问题进行有益的探索,并为法律职业阶层问题的实证研究增
添一点累积的材料。当然,如果能为中国的司法改革者们提供一份可供参考的资
料,无疑是笔者的莫大荣幸。

Abstract
In nowadays, the legal profession almost e a trend of globalization. It is
gratifying that building of the law Synchronize with this trend. In the 1997, The 15th
Party Congress formally established ruling the country with law for the country's
basic strategy of leading the people administering the country. After these 10 years
practice, the implementation of the basic strategy of governing the country according
to law, there form of China’s judicial system, the improvement of the legal
supervision, achievement of a just justice, the rule of law concepts, such as
propaganda, have made a large improvement in the world. In the report to the
party’s 17, it have made clear that unswervingly develop socialist democracy, fully
implement the basic strategy of governing the country according to law. How to fully
implement the basic strategy of the Party mittee is the major thing for
China’s legal men.
