摘要:过去很长一段时间,我国民法理论和民事法律法规都否认精神损害,尤其不承认精神损害赔偿。其主要理论依据是:自然人的人格尊严是不能用金钱来衡量的,也是不可以用金钱来赔偿的。生命、健康和自由等人身权于每个人都是最神圣的权利。这种权利的丧失所造成的精神痛苦是无法弥补的。现代法律理念最重要的发展趋势就是对人的尊严、人的权利的关注和保护。我国是个有重义轻利传统的国家,历来将精神与金钱分开。随着社会的发展和文明程度的提高,法律规定以经济惩罚来补偿或赔偿受害人的精神损害已成必然。然而,我国的现行法律对精神损害赔偿的规定存在着较多缺陷。我国刑事和行政领域应建立精神损害赔偿制度,以保证我国建立精神损害赔偿制度的规范与完善。

Abstract:In the past for a long time, China's theory of civil law and civil laws and regulations are denied the spirit of the damage, in particular, does not recognize the spirit of the damages. The main theory is based on: the natural human dignity is not measured in ary terms, but also can not use the money pensate. Life, health and personal rights such as freedom of every person are the most sacred rights. This caused the loss of the right spirit is suffering irreparable. The most important modern legal concept of development is the trend of human dignity, human rights and protection concerns. China is a traditional emphasis on just Lei light, and always will be the spirit of separation. With the development of society and civilization increased, with financial penalties for the law pensate victims pensation for moral damage has e inevitable. However, China's existing laws on damages in the spirit of the provisions of the existence of more defects. China's criminal and administrative areas should be established for moral pensation system in order to ensure the establishment of our moral pensation system and improve standards.
