本文是对土地征用补偿中法律制度的研究,从法律理论和实际案例出发,论述现行
征地补偿法律制度中存在的问题,并对问题进行分析,找出解决之道。本文主要分为三

研析和中国农村土地征用补偿法律制度之构建。
第一部分:我国农村土地征用补偿法律制度概况
这部分首先简要论述了建国以来有关征地补偿制度的法律发展,对比从计划经济到
市场经济发展过程中,土地征用补偿法律制度的不断完善。其次对现行征地补偿法律关
系进行分析,阐明征地补偿行为的法律性质,补偿原则及补偿关系中主客体的特点。最
后总结并论述了我国农村土地征用补偿的法定程序。
第二部分:我国农村土地征用补偿法律制度现状研析。
本部分主要是对征地补偿法律制度的运行困境从实体法和程序法两个方面进行论
述。首先论述我国农村土地征用补偿制度实体法方面存在的问题,包括农村土地产权主
体多元导致征地补偿法律关系中主体的多元化,现行法律对征地补偿原则界定模糊,补
偿标准规定过低,补偿方式单一及补偿费分配不合理等;然后论述了我国农村土地征用
补偿制度程序法方面的缺失,我国现行征地补偿法律制度既没有正当法律程序的规定,
也没有司法程序的救济。
第三部分:我国农村征地补偿法律制度之构建
本部分主要根据第二部分中论述的问题提出解决之道,同样从实体法和程序法两个
方面构建适合市场经济发展的征地补偿法律制度。首先,完善征地补偿制度实体法的规
定。在法律中明晰农村土地产权主体,根据营利与否对征地补偿法律关系进行具体分类;
明确规定征地进行公平补偿原则,提高征地补偿标准;建立补偿金市场评估机制,使土
地逐步进入一级市场,使失地农民直接享有土地增值收益。其次,构建征地补偿制度程
序法。我国还没有一部关于征地程序的法律来保护失地农民的合法权益。制定一部符合
市场经济的征地程序法,有利于对农村集体和失地农民权益的保护;增加对征地补偿的
司法审查,使司法权有效监督行政权,防止行政权的滥用和扩张。

Abstract
The thesis is to research on the legal system pensation for land requisition,It
discuss about the problem of pensation for land requisition in legal system ,from two
aspects of the legal theory and the practical cases, analyse the problem and then find a
solution. The article is divided into three parts:summarize,study and reconstruct the legal
system pensation for land requisition in China’s rural areas.
Part1:The summary description for the legal system pensation for land
requisition in China’s rural areas
The first part briefly discusses the legal development of the land requisition
compensation system since the founding of new China, contrast from the planned economy to
the market economy, the legal system of land pensation contisues to improve.
Secondly, the analysis of the current land pensation legal relationship, the
legal nature of that land pensation behavior, characteristics of the main object
pensation principle pensation in the relationship. Finally summarizes and
discusses pensation of the rural land
