矿山生态环境恢复治理保证金制度作为一个有效的矿山环境保护制度,已经在我国全
面开始实施了,但是在实施过程中还存在着许多的问题,还有许多需要完善的地方。本文
立足于我国矿山生态环境恢复治理保证金的现状,借鉴国外先进矿业国家在矿山生态环境
保护中的先进经验,提出完善我国生态环境恢复治理保证金制度的一些制度和政策上的建
议。通过研究,本文认为矿山生态环境恢复治理保证金是基于环境利益而给采矿权人设定
的一项义务,它所体现的是一种环境利益,这种利益是不同于其他利益的,它是采矿权人
必须履行的一项法定义务,也是一项强制义务。本文的研究包括以下几个部分:
第一部分:我国矿山环境问题与矿山生态环境恢复治理保证金。本部分对我国矿业开
发中造成的生态环境问题进行了分析,并对矿山生态环境恢复治理保证金的基本含义、法
律和功能以及建立矿山生态环境恢复治理保证金的理论基础进行了探讨。
第二部分:我国矿山生态环境恢复治理保证金制度现状分析。本部分从法律、政策、
地方性法规等方面,对我国矿山生态环境恢复治理保证金制度的现状进行了分析,在此基
础上,进一步分析了我国矿上生态环境恢复治理保证金制度存在的主要问题。
第三部分:国外矿山生态环境恢复治理保证金制度评价与启示。本部分主要介绍了美
国、加拿大、澳大利亚、日本、德国等发达国家在实施矿山生态环境恢复治理保证金制度
方面的做法和经验,并对这些国家在实施矿山生态环境恢复治理保证金制度方面值得我国
借鉴的地方进行了总结。
第四部分:我国矿山生态环境恢复治理保证金制度的完善。本部分针对我国矿山生态
环境恢复治理保证金制度存在的主要问题,从加强立法、理顺管理体制、明确保证金缴纳
的界限、比例和期限、改革采矿许可证制度、严格规定保证金返还条件、建立保证金信用
制度以及加强监督管理等方面,对完善我国矿山生态环境恢复治理保证金制度的问题进行
了探讨。

Abstract
The mine ecological environmental restoration and management deposit system as a
guarantee of an effective system of environmental protection has been fully implemented in our
country, but in the implementation process, there are still many existing problems and many
places to be thesis is based on the present situations of mine ecological
environmental restoration and management deposit system in China, using the advanced
experience of other advanced mining countries in mine ecological environment protection for
reference, to put forward some effective suggestions for ecological and environmental restoration
and deposit system, including some system of governance and policy mendations. Through
the research, this thesis holds that the ecological and environmental restoration and
management of mining deposits is based on the environmental benefits to the mining rights of
people, it sets an obligation, it embodies an environmental interests, which is different from other
interests, it is a legal obligation that mine owner must obey, but also a mandator
