摘要
自律师制度恢复以来,律师对我国法制建设起到了关键作用,但是,我国对律师执业权利及权利保障规定的不足,制约了律师在社会生活中起到更为积极的作用,这一点在刑事诉讼中体现得较为明显,律师刑事豁免权立法上的欠缺,使得律师在执业过程中受到不公正待遇甚至刑事追究。
鉴于我国目前的立法与司法现状,赋予律师刑事辩护责任豁免权有一定的必要性和迫切性。本文从我国律师刑事辩护豁免权的含义出发,指出了我国律师在刑事诉讼活动中言论、作证、及提供证言、材料失实三个方面缺失豁免权,并分析了其缺失原因,之后针对原因,从更新观念、改革体制、完善立法、加强自身修养等方面提出了解决措施,以期能够解决我国律师刑事辩护豁免权缺失的现状。

ABSTRACT
Since reform and opening up lawyer system recovery after for our human rights situation since lawyers to ascend and maintenance of legal play key, the legal profession, with its with professional and prominent role got social highly. But, our country to lawyer rights and right protection provisions insufficiency, restricted the lawyer in social life is more active role plays this point in criminal lawsuit embodied criminal immunity is obvious lawyer, makes the lack of legislation on lawyers in the practice process is not being treated fairly even criminal investigation.
In view of legislation and judicature’s present situation in our country,it is necessary and urgent to endow defense lawyers with criminal on the current criminal defense lawyer on the meaning, and points out that immunity from China in lawyers in criminal lawsuit activity of speech, testifying and give testimony, materials and any loss immunity, three aspects and analyzes its missing reasons, for reasons, after from renewing conceptions, reform system, perfecting legislation, strengthening self-cultivation, etc, so as to measures are put forward to solve our country criminal defense lawyer s
