摘要
因特网的高速发展,对世界各国的政治、经济、文化等方面带来了深远的
影响,同时也给人们的生产生活带来了极大的便捷。网络服务商传播的信息越
来越多的介入经济生活。网络上的信息浩如烟海,信息内容和传播方式花样翻
新。由于网络开放、交互式、终端用户独立自由等特点,也使网络本身对不良
信息缺少天然的屏障,只有充分利用网络的特点,抓住信息发出端和接收端的
关键环节,才能维护网络信息安全,促进网络良性发展。规范网络服务商在信
息传播中的义务和责任对于维护经济秩序、保障交易安全、维护消费者权益越
来越具有重要意义。网络服务商如何发挥信息“过滤器”和“把关人”的作用,
是一个亟待解决的课题。
网络服务商已经被纳入我国的管理体制之内,因此,只要抓住网络服务商
这一关键环节,就能够有效地控制网络信息传播的途径,及时、有效追查并消
除违法、犯罪的后果。将网络服务商作为关键来抓,就要充分发挥网络服务商
维护网络安全的作用。
本文首先归纳了我国网络服务商在链接过程、信息发布过程中所存在的问
题,进一步对我国网络服务商监管的现状做分析后发现,我国网络服务商监管
存在的问题有:一、现有的网络相关法律法规内容不适用,二、我国网络服务
商监管体系不完善。由于以上原因,造成我国对网络服务商的监管水平与网络
发展不适应。
其次,本文运用比较和实证的方法,描述了诸如美国、欧盟、亚洲等地区

对网络服务商监管所采取的措施和手段,通过对各国在网络服务商监管上采取
的模式分析,得出完善我国网络服务商监管体制有引导意义的启示。
最后,本文指出要在促进网络发展的基础上加强对网络服务商的监管应该
采取立法主导与行业自律相辅的模式。加强立法、鼓励行业自律,完善网络技
术规范和网络法律规范,加大执法力度,强化社会监督等方面对我国网络服务
商监管提出对策。

ABSTRACT
With the development of the , the world's political, economic, cultural
and other aspects brought the profound influence. The dissemination of the massages
by Service Provider (ISP) also affects our economic lives. Because of the
particularity of the , it also makes the lack of the natural barriers,
which can defend the security of effectively according to seizing the key link
of the information sending and receiving.
It is of great significance how to regulate Service Providers in the
dissemination of information. China'works has just started, and ISP
plays an important role, according to promoting the development work based on
network, ISP will act as "filters" and "guard" role on .
