作为一种新兴的行政监管手段,有奖举报制度的推行能够有效缓解行政执法资源

行政执法有奖举报制度具有丰富的内涵,它既是行政执法的辅助手段,又是公众参与
的特殊方式,还是权利救济的重要渠道。现有法律文本和实践运作均显示,行政执法
有奖举报制度的进一步完善,在于制度本身收益、便利、高效、安全的四维推进,更
在于良好社会环境的营造。政府以身作则、加强宣传,激励更多的公民积极行使法定
的举报权利,最终形成社会治理的新模式。

The study of Incentive System on Reporting
of Administrative Law Enforcement
Abstract
As a new method for administrative law enforcement, Incentive System on Reporting
can effectively alleviate the shortage of the resources and attract the public power to
participate in social regulation. Finally, it will form a distinctive model of public-private
partnerships regulation. Although it is under questions, Incentive System on Reporting of
administrative law enforcement has strong legal basis on public management,
constitutional law, administrative law and legal culture foundation. It is a pull of the
Reporting. Incentive System on Reporting of administrative law enforcement has a rich
connotation. It can be an auxiliary mean for administrative law enforcement, or a special
way for public participation, or an important channel for rights relief. Legal texts and
practical operations both show that to make the system itself more benefit, more
convenient, more efficient, more safe and to create a favorable social environment are two
ways to perfect Incentive System on Reporting of administrative law enforcement. The
Government is more responsible to attract more people exercise their rights. All these can
make contributes to the formation of a new mode of social governance.
