摘要
案外第三人撤销诉讼程序是大陆法系一项重要的民事诉讼制度,具有深刻的理论意
义和现实价值。德国、法国、中国台湾、澳门特别行政区都设置了案外第三人撤销诉讼
程序。尽管它们在各自国家的具体名称各异、在法律体系中的地位也不相同,但是他们
的立法目的都是相同的,就是赋予虽然未参与本诉程序但是受到本诉判决效力损害的案
外第三人事后的程序保障权。没有程序的正义就没有结果的正义。案外第三人撤销诉讼
程序发挥着重要的事后补充救济功能。因此上述国家的法律虽然历经修改,但是案外第
三人撤销程序始终得以保留、发展、完善。
案外第三人撤销诉讼程序的实体理论基础是宪法人权保障论、成本控制论;程序保
障论是案外第三人撤销诉讼程序的程序理论基础。尽管各国都从事前保障(法院的适正
通知、当事人的申请参加)和事后保障(再审程序、执行异议)对案外第三人进行保护,
但是如果当事人合谋进行诉讼欺诈、仲裁欺诈时或者法院根本就不知道谁是第三人时事
前通知根本起不到应有的保障作用;当启动现有事后保障程序时,案外第三人面临着利
益受损却无主体资格的尴尬境地。毋庸讳言,建立案外第三人撤销诉讼程序有其可能性、
必要性和可行性。因此,案外第三人撤销诉讼程序的立法应当提上议事日程。
“他山之石,可以攻玉”,我国构建案外第三人撤销诉讼程序可以借鉴法国、德国、
日本、中国台湾、澳门特别行政区有关于第三人撤销程序的法律制度。当然对于法律制
度的移植不是简单的照抄照搬,需要根据国情进行改造从而使其与我国的各项制度相互
匹配衔接,切实做到“博采众长、融会贯通、以我为主、自成一家”,建设成具有中国
特色的法律救济程序。

Abstract
The third person outside the case of revocation proceedings is the civil law as an
important civil litigation system, which has a profound theoretical and practical value.
Germany, France, China, Taiwan, Macao Special Administrative Region set the matter of
outside the revocation proceedings. Although they are different in neither the specific name
of the respective countries,nor the status of the legal system is not the same, Justice of the
program and the results of the just. Third person outside the case to revoke the proceedings
play an important relief function of an afterthought. Therefore, although the laws of these
countries after the modification, the case of third party outside the cancellation procedure is
always preserved, develop, and improve.
