一、汇票的定义
汇票是出票人签发的,委托付款人在见票时或在指定的日期无条件支付确定金额给收款人或持票人的票据。

采用“行为地法律”,若无,可以出票人名称中所附地址作为出票地,或以出票人的营业场所、住所或经常居住地作为出票地。

3、出票日期(Date of Issue)
我载项目,出票人未注明出票日期的汇票仍有效,收款人有权自行加上出票日期
作用:
(1)确定票据的有效期
(2)决定付款到期日
(3)判定出票人的行为能力

4、付款期限(Maturity/Time of Payment/Tenor)

(1)见票即付(Payable at Sight / On Demand)
(2)定日付款( Payable at a Fixed Date)
(3)出票后定期付款( Payable at a Determinable Date After The Date of Drawing a Draft)
(4)见票后定期付款( Payable at a Determinable Date After Sight)

确定付款到期日的国际惯例:
A、算尾不算头
B、月为日历日
C、半月按15天计算
D、先算整月,后算半月
E、节假日顺延

例:付款期限为at 90 Date After Sight,若承兑日为10月3日,则付款到期日为哪天?
次年1月1日,若该日为假日,则为1月2日
例:付款期限为at 3 and a half month After 15th Feb,则付款到期日为哪天?
5月30日
例:付款期限为at 1 month After 30th Jan的汇票,则付款到期日为哪天?
2月28或29日(不跨月原则)

6、收款人(Payee)俗称“抬头”

(1)指示性抬头,又称记名抬头
特点:可由收款人背书转让

(2)限制性抬头。
特点:出票人只对收款人负责,若收款人转让汇票,则后手的票据权利不优于收款人,且只能联合收款人一起向出票人行使追索权。
