文档介绍：I摘要随着社会主义法制建设的发展和监狱工作的改革,尊重和保护罪犯权利已经成为监狱依法治监和文明管理的一项基本要求。特别是2004年,“国家尊重和保障人权”的入宪,标志着我。在这种形势下,作为弱势群体的罪犯的权利保护受到越来越多的关注。罪犯的婚姻家庭权作为罪犯权利的重要组成部分,是一个值得我们关注和研究的问题。婚姻家庭权作为自然人的一项基本人身权利,监狱罪犯也应当享有,保障罪犯的婚姻家庭权,有利于罪犯的教育改造,维护社会的稳定,也有利于人权保障和刑罚执行目的的实现。监狱罪犯作为特殊群体,其人身自由受到限制,实际中很难如普通的公民一样行使其婚姻家庭权,而且在现实中罪犯婚姻家庭权利的很多内容都存在法律盲区,在监狱执行的过程中受到侵犯而无法救济。通过对罪犯婚姻家庭权的研究,总结其概念、特点以及具体内容,针对罪犯婚姻家庭权利在实现过程中存在的立法和执法缺陷,分析其原因以及提出相关的完善措施,以其在寻求罪犯婚姻家庭权与监狱管理的平衡点的基础上,更好地实现对罪犯婚姻家庭权利的保护。关键词:罪犯;婚姻家庭权;缺陷;完善IIAbstractAlong with thedevelopment of the socialist legal system construction and the reform of prison work, respecting and protecting the criminals' rights have e a basic requirement of prison management according to law and civilization governance. Especially in 2004, the advent of "state respects and safeguards human rights" expressed that Chinesesocialist democracy and construction of legal system had achieved to a new level. In this situation, as one of the vulnerable groups,the protection of criminals’ rights received more and more attention. Criminal’s rights of marriage and family, as an important part of the criminals' rights, are worth getting our attentions and researching. The rights of marriage and family, as a basic natural right of human beings, the criminals also should enjoy them. The guarantee of criminals’ marriage rights is beneficial to education and reform of criminals, maintaining social stability. Moreover,it is also profitable to guarantee of human rights and the realization of penal execution a special group, criminals’ freedom is restricted. In practice, it is hard for them to exercise their rights ofmarriage and family as ordinary citizens do. Also, it is true that some legal blind areasdo exist in contents of criminals’ marriage and family rights, and criminals who suffered infringement in the course of prison execution cannot acquire any help. By researching rights of crimina
