THE CONSTRUCTION RESEARCH OF HARBIN URBAN PLANNING REGULATION SYSTEM Candidate:Chen Xiao Jiu Supervisor:Associate Prof. Wu Song TaoAcademic Degree Applied for:Master of EngineeringSpecialty:Architectural and Civil EngineeringAffiliation:Harbin City Planning Bureau Date of Defence:Apr. 2006Degree-Conferring-Institution:Harbin Institute of Technology哈尔滨工业大学工程硕士学位论文摘要随着经济社会和城市经济的加快发展,现行的城市规划管理体制无论在内容、还是方法上都很难定量、甚至定性地把握城市发展动态,已经不适应城市建设发展的需要。另外,《行政许可法》的颁布实施使城市规划管理依法规划、依法行政、依法实施成为必然,因此,在地方法规层面上建立一个以《中华人民共和国城市规划法》为核心,国家立法与地方立法、行政管理法规与专业技术管理规范、法定规划与地方技术管理规程相配的城市规划法规体系是非常必要的。论文对以美、英、法、德为代表的西方发达国家以及中国香港特别行政区的地方城市规划法规体系模式进行了深入探讨,并将我国的城市规划审批管理机构和审批管理形式与西方发达国家进行了比对。面对经济体制转轨、产业结构调整、城市急剧扩张和城市化进程日益加速等诸多变化,论文还对我国城市规划管理、运行体制以及我国城市规划行政管理体系的基本模式进行了分析,同时,对哈尔滨市城市规划管理体制和现行城市规划管理体制存在的问题进行了剖析,指出了哈尔滨市城市规划管理体系的症结所在。论文运用制度创新理论,结合哈尔滨城市规划管理的实际情况,针对哈尔滨市城市规划管理工作的具体要求,从改善哈尔滨城市规划行政体制、建立健全哈尔滨城市规划编制成果体系、搭建哈尔滨城市规划的法规框架以及规范哈尔滨城市规划审批制度等方面对建构哈尔滨城市规划法规体系提出了对策及初步研究成果。关键词城市规划;哈尔滨;城市规划管理;法规体系;城市规划法规- I - 哈尔滨工业大学工程硕士学位论文Abstract With the quick development of economic society and city economy, the existing system of urban planning management can not control urban development trends by quantitative even qualitative analysis, also can not match with the requirements of urban construction,The implementation of“Administrative Permission Law”insure that to plan, administrate and implement according to the law is necessary ofurban planning management .Therefore it is necessary to create an urban planning lawful system at local level, which takes the “Urban Planning Law of the ”as the core and features the suitability between state and local lawmaking, administrative and professional management rules and legal planning and local technical management regulations.
