文档介绍：1内容摘要我国清洁能源基金对清洁能源的开发利用、推广发展具有至关重要的作用。但是由于我国针对清洁能源基金相关立法的缺失以及现有的法律规范对整个基金行业规制的不完善,使得我国清洁能源基金的运作频遇瓶颈,举步维艰。为了能够明晰我国清洁能源基金法律制度的不足之处,并为清洁能源基金的发展提出合理化的建议,文章将对清洁能源基金在民间慈善、政府调控及市场支配条件下发展所面临的问题进行系统性的研究与分析。文章首先通过对基金与清洁能源含义的探讨,厘清我国清洁能源基金的概念。而且根据清洁能源基金资金来源的不同介绍了我国清洁能源基金的主要存在形式,与此同时还揭示了我国清洁能源基金的性质与功能定位。其次文章进一步梳理了目前可适用于我国清洁能源基金的法律规范,明确了我国清洁能源基金在资金来源单一、监管不力、使用不透明及信息披露不对称四个方面存在的问题及成因。最后文章在借鉴美国清洁能源基金发展经验的基础上,从拓宽基金资金来源、强化基金治理结构、规范基金资金使用以及完善基金信息披露四个方面为我国清洁能源基金法律制度的完善提出合理的建议。关键词:清洁能源基金;法律制度;完善1AbstractThe clean energy fund of china plays an important role in the exploitation, utility, promotion and development of the clean energy. The lack of relevant legislation and inadequate laws and regulations of the clean energy fund leads to the difficulty in operating the fund. In order to shed light onthe inadequacies of the legal system of China's Clean Energy Fund, and to make mendations for the development of it, this thesis will analyze clean energy fund’s problems reflected in its development under the circumstances of civil charity, government regulation and market , this paper clarifies the concept of clean energy fund after probing into the meaning of clean energy and the fund. Then it introduces the main forms of clean energy funds according to the different sources of funds, and at the same time, it also reveals the nature and the function of the fund. Secondly, after sorting out the laws and regulations which could be applied to clean energy fund, the paper analyzes four issues of the fund, including the single source offunds, the lack of supervision, the opaque use and the asymmetric information disclosure.
