文档介绍：首都经济贸易大学硕士学位论文农村土地承包经营权流转法律问题探讨姓名:孙树华申请学位级别:硕士专业:民商法学指导教师:刘润仙20100301首都经济贸易大学硕士学位论文农村土地承包经营权流转法律问题探讨I 农村土地承包经营权流转法律问题探讨内容提要近年来随着一系列中央农村会议的召开,官方与民间媒体大力倡导实现农村集体土地承包经营权流转以解决三农问题。特别是2008年9月30日胡***总书记在视察小岗村时提出“要赋予农民更加充分而保障的土地承包经营权”;“允许农民以多种形式流转土地承包经营权,发展适度规模经营”。因此,笔者基于我国目前农村土地制度改革热点问题而进行阐述。综合运用了民法基本理论、物权法、行政法学等学科知识,采取历史与现状、弊端与矛盾比较研究方法,对农村集体土地流转中土地主体制度、农村集体土地流转的主体意愿及从多角度对农村集体土地流转的模式进行了初步阐述,为构建农村集体土地流转理论的基本框架,进一步完善和发展农村集体土地理论提出了一些建议,特别是在土地主体重构、流转过程中的土地价格因素分析并填补了当前关于农村集体土地承包经营权流转的理论盲点,并提出了一些不成熟的法律对策,具有一定的理论性和现实性。文章通篇以民法总则中的基本理论为基础,综合运用多学科理论,在部分内容中进行跨学科的综合研究,促进了对农村集体土地流转过程中出现的问题的认识以及如何解决这些问题有着积极意义,冀望对我国当前集体土地流转法律制度的完善与发展起到一定推动作用。关键词:土地流转;构建;土地定价;法律对策首都经济贸易大学硕士学位论文农村土地承包经营权流转法律问题探讨II The legal measures on the problems of rural land contractual of management rights circulation Abstract In recent years, the central government had hold a series of meetings about rural areas, the official and private media advocate the rural collective land contractual management rights transfer to resolve the problems of farmers benefit and new rural building .In particular, when President Hu Jintao visited Xiaogang at September 30, 2008, he said to give farmers more fully and to protect the right to land contractual management" and "allow farmers to transfer land contractual management rights in various forms and develop an appropriate scale of operation".
