文档介绍：论宪法的社会基础宪法学与行政法学专业研究生:胡燕指导教师:杨泉明本文在分析论述宪法社会基础一般理论的基础上,对中、西方宪法社会基础进行了比较,进而探讨了中国宪法社会基础的培育和完善。文章在对宪法社会基础的概念、特征和内部结构进行阐述后指出:宪法的产生和宪政的运行离不开社会基础的支撑。中、西方宪法之所以经历了不同的制宪历程和发展过程,其深层原因在于社会内部结构的不同。西方社会自发形成的市场经济和市民社会,多元化的政治结构以及个人自主性精神有力地推动了近代宪法的产生和运行:西方宪法社会基础的动态发展又进一步地推动了其宪法的发展变化。中国宪法是为求富强而先求宪政的产物,缺乏良好的宪法社会基础,具体体现在传统的国家和社会合一结构的影响,市场经济体制不完善,缺乏多元利益集团对权力的制约,公民意识淡薄等方面。另一方面,也应看到随着经济、政治体制改革的深入,中国宪法的社会基础正在初步建立和发展。在培育和完善宪法社会基础的过程中,西方的经验固然值得借鉴。但是,也必须立足于中国的实际发展市场经济、健全公共领域、培育多元利益集团和提高公民意识。关键词:宪法社会基础社会结构宪政价值比较分析培育和完善The Social Basis of ConstitutionMajor: The Science of Constitutional and Administrative LawPostgraduate: Hu-YonTutor: Yang-QuanMingThe essay analyses and illustrates mon theory of the constitutionalsocial basis made clear the purpose from the very beginning.
