文档介绍：2正当防卫若干问题研究中文摘要I正当防卫若干问题研究中文摘要正当防卫是刑法规定的一个法定量刑情节,在司法实践中遇到的案例也较多,然而刑法的明确规定并不代表着司法运用的效果就好,在我国的司法界对正当防卫的限度、不法侵害的内容等就存在着不同的认识,导致了正当防卫制度很难贯彻,甚至运用的程度远不如被害人过错这样一个非法定情节。笔者从一个案例入手,引出司法实践中运用正当防卫制度时产生的争议焦点,结合该制度的立法宗旨、构成要件等进行学理上的分析、论证,并就如何认定防卫限度、不法侵害等问题进行探讨,进而希望能找到化解实践难题的方法。第一部分,笔者首先分析一个司法实践中经常遇到的案例,列举了司法机关对该案的争议,以及司法文书中对该案的认定,体现着我国刑事司法的实际,并为下面的分析论证找素材。第二部分,笔者对各国刑法中对正当防卫限度的立法情况进行介绍和比较分析,指出立法上设立正当防卫必要限度的意义。第三部分,探讨我国刑法正当防卫必要限度的司法认定。阐述防卫限度的概念、性质,对理论界关于防卫限度的各种学术观点进行比较分析,提出防卫必要限度的考量依据。并结合防卫限度探讨防卫过当的性质以及特殊防卫权问题。第四部分,探讨不法侵害中的疑难问题。阐述了不法侵害的概念、中文摘要正当防卫若干问题研究II特征,强调认定正当防卫就必须首先明确不法侵害的内容和实质。并从不法侵害的来源、性质、特征等角度对一些理论上存在争议的难点问题进行了分析论证。在第五部分中,结合上述理论分析,对本文列举的案例进行评析,并提出正当防卫制度的完善建议。关键词:正当防卫防卫限度不法侵害立法完善作者:潘玉琴指导教师:顾婷Research on Issues of the Justifiable DefenseAbstractIIIResearch on Issues of the Justifiable DefenseAbstractJustifiable defense is a legal circumstance of criminal law, and there are a lot of cases in the judicial practice. The definite provisions of the criminal law, however,did not represent that the effect of the judicial practice is good. In judicial circles, there are different understandings about the boundary of the justifiable defense and the content of violation, which make the justifiable defense system difficult to carry out,and even some non-statutory plots such as the victim fault are more easier to from a case, the author introduces the dispute focus on the use of self-defense system in judicial practice; combined with the legislative purpose and the constitutive requirements of the system,the author does some theoretical analysis and demonstration about the system, and discuss some problem about how to identify the boundary of the defense, violations and other issues concerned, hoping to find some way to resolve the practical first part: the author analyzes a case that frequently appears in judicial practice, lists the controversy on the case , as well as
