文档介绍：Legalthoughtsonthemacro-controlofrealestateprice ------inaperspectivetheof"thenewfivearticles" A Dissertation Submitted for the Degree of Master Candidate:Wang Xinru Supervisor:He Guihua Chang’an University, Xi’an, China I 摘要面对我国房价的不断攀升,研究我国房地产价格调控政策,梳理房地产价格调控法律现状,分析房地产价格调控措施合理性与合法性,寻求房地产调控政策的合理设置, 促使房地产价格的合理回归,对推动房地产业健康发展,改善人们生活水平,促进社会经济和谐发展具有重要且深远的意义。本文立足法学角度,以“新国五条”为视角,对我国房地产价格调控政策进行研究。本文主要运用了资料搜集法对历年调控政策及效果进行汇总和分析;运用了描述性研究法对“新国五条”内容、特点进行阐述;运用了社会效益和经济效益法研究“新国五条”在动态实施中所带来的市场和社会反映;运用了理论与实证分析法对我国现行房价调控手段进行理论与实效分析;最后提出完善我国房地产价格调控的法律建议。本文共三章。第一章为“起底”国五条,首先通过对以往调控政策的回顾和梳理, 并对它们进行效果分析,说明调控效果不明显,客观上促使了“新国五条”的出台。随后笔者对“新国五条”的内容、特点以及出台后的市场效果进行了研究。第二章为“新国五条”调控措施法律问题分析。分析了“新国五条”中几种主要的调控措施:行政限购措施、金融调控措施、土地调控措施、税收调控措施的特点及存在问题。第三章为完善房地产价格调控的法律建议。从完善调控制度的立法体系、提高房地产价格调控法律实效、建立和完善政府调控房价的法律责任机制等角度对现有的几种主要调控措施提出完善建议。本文在借鉴已有研究的基础之上,对我国房地产价格调控政策进行系统全面的论述,对具体调控措施存在问题进行分析,提出完善宏观调控措施的法律意见,以求能使我国房地产价格调控做到科学、合理,对理论和实践有所裨益。关键词:新国五条;房地产价格;宏观调控;调控措施 II Abstract Faced with a growing real estate price, research on our real estate price control policy, sorting the situation of existing real estate price control on a legal perspective, analysis the rationality and validity of the real estate price control policy as well as seeking a path to a reasonable policy to bring back a reasonable real estate price which will finally ensure the healthy development of our real estate market, improve the life quality of our people, and the harmonious development of the social economy. This paperlooks into our existing real estate price control policy from the perspective ofthe “new five articles”on a legal basis. The paper cites past policies and analysis their effect, introducing the contents and characters of the “new five articles”. The measure of analysison social and economic benefitsis used to study the effect the social economy after its implementation. The theoretical research and empirical analysis methods are used
