文档介绍：重庆大学硕士学位论文中文摘要摘要妇女、儿童是当今社会的重要组成部分,同时也是社会稳定的重要根基。妇女儿童因其自我防范和保护能力相对较弱历来是犯罪中容易遭受侵害的群体,拐卖妇女儿童犯罪往往会引发一系列社会问题,直接影响社会的和谐与稳定,此类犯罪也是社会各界共同关注的热点问题。拐卖妇女、儿童犯罪就其本质而言是犯罪分子把人当成商品来交易,这种行为不但严重地侵害了被拐卖妇女、儿童的身心健康,也是对她们作为人的尊严的侵害,是我们现代文明社会所不能容忍的。世界各个国家也将其作为一类严重的犯罪行为重点打击。本文正文共四个部分: 第一部分主要介绍了拐卖妇女儿童犯罪的现状及特点、成因、危害。对拐卖妇女儿童犯罪有了更具体、更深刻的了解,从而更好地去探讨该罪的其他相关问题。第二部分分析了拐卖妇女儿童犯罪的对象,通过具体的山西黑砖窑案例和拐卖***人的案例来进一步提出扩大拐卖人口罪的对象,应包括14周岁以上的男性和其他人(主要指***人)。第三部分分析了拐卖妇女罪是否要求违背被害人的意志为必要条件,分别从理论上的肯定说和否定说加以探讨分析,最后得出笔者自己的见解,不以被害人的意志为必要条件,但没有违背被害人意志的,应当从轻处罚。第四部分提出了要完善拐卖妇女儿童罪的立法见解,包括的观点有:数罪并罚、扩大犯罪对象、加大追究买主刑事责任的立法、奸***不包括自愿发生关系(***除外)。关键词:拐卖妇女儿童,危害,法律完善重庆大学硕士学位论文英文摘要 ABSTRACT Women andchildren is animportant part ofthesociety,but alsothe socialstability andchildrenbecause ofitsselfprotectionability to prevent and relatively weak hasalways been acrimevulnerable toviolationsofgroup, human trafficking ofwomen and children often would trigger acrime aseriesofsocial problems,directly influencethestability ofthesociety,this kindofcrimeisthefocusof thesociety from all walks ofwomen andchildren inthe essence ofthecrime is tobuy and sellgoods willbe as seriousviolations against women children’Spay7sicaland mental health,but alsoofthehuman dignity as akindof extreme violation,for themodem civilizationcan't willalso its as a kindofseriouscrime tohit. The second part ofthetrafficking ofwomen and childrencrimeanalysis ofthe object,the brick kilns in Shanxi Province through concrete cases andtrafficking LiangXingRen case toput forward furtherexpand anyhuman trafficking ofobject of thecrime,should include 1 4years old ofmen and others(mainly refers tothe LiangXingRen). Thethirdpartanalyzes thetrafficking women sinagainst thewillofthevictimare
