文档介绍：摘要死刑执行程序是保障死刑犯权益的最后一道屏障,故而死刑的执行过程理应更加规范化、人道化。通过对现行死刑执行制度中存在的问题进行全面的分析和研究,并就死刑执行程序的规范化、有序化提出相关的建议,以期对我国死刑执行程序的完善以及刑罚执行的文明化有所裨益。本文总共分为四部分: 第一部分,死刑执行程序概述:死刑执行程序是指执行机关和监督机关从死刑执行命令的签发开始,各司其职,将犯人处死完毕,并执行完相关善后事宜后才结束诉讼活动的一种刑事诉讼程序。死刑的执行具有不可救济性、极端严格性、快速性及简捷性。第二部分,死刑执行程序的相关考察:对我国死刑执行历史的回顾和世界视野下死刑执行程序的考察,并着重对美国和日本的死刑执行制度进行了比较分析,对两国死刑执行的人数、执行的方式、执行的监督及死刑执行后的善后程序做了详细的阐述。第三部分,死刑执行程序的价值分析:死刑执行程序中所蕴含的价值主要包括死刑执行程序中的正义、平等、效率等基本价值以及死刑执行过程中对被执行人的生命关怀的人权价值和人道主义价值。第四部分,死刑执行程序的制度构建:从立法上到司法实践中, 我国死刑执行程序都存在着一些漏洞和不足之处,其完善应当从以下几个方面入手:扩大申诉的范围、延长死刑犯的申诉期、保证律师的介入,切实保障死刑犯的申诉权;对传统的执行监督主体的优化,明确规定死刑的监督主体为监所检察部门,创设具有中国特色的死刑见证人制度;规范死刑执行方式,赋予死刑犯平等的执行方式选择权; 保障死刑犯会见律师和亲属的权利;完善死刑执行后对犯人尸体、器官的处理程序;设置死刑特赦制度。关键词死刑;死刑执行;死刑执行程序 ABSTRACT Death penalty execution procedure isthelastguarantee ofthedeath penalty culprit’s rights,hence deathpenalty procedure should be more standard, acomprehensive analysis and research ofthe problem in current deathpenalty execution procedure,and put forward some advices about our country’S deathpenalty execution procedure in order toperfect itand benefitthecivilizationofpenal text isdivided intofour-part: Chapter one,Death penalty execution procedure summary:death penalty execution is acriminal litigationprocedure that starts from the countersign of death penalty beginning,and then the execution department andsurveillance department according tothelaw todo their own duties,until aprisoner is sentenced plete relative after-care death penalty execution process embodies the haracteristicsofunredressed,strictness andquickness.
