文档介绍：中文摘要摘要:保密审查制度作为政府信息公开建设的核心制度,直接决定着政府信息公开的范围和限度,体现着社会主义民主法治、政府先进执政理念和。完善、科学、缜密、权责明确的的政府信息公开保密审查机制有助于解决政府信息公开制度建设和实践中的难点问题,对于健全民主政治、推动行政体制改革、监督行政机关行政权的行使、防止权力寻租和权力腐败、实现社会资源共享和建设社会主义和谐社会具有不可低估的重要作用。当前,尽管政府信息公开与保守国家秘密的相关联系己经引起了国内学界足够的重视,并产生了一系列的研究成果,但对于《政府信息公开条例》和2010年新颁布的《中华人民共和国保守国家秘密法》的协调实施还涉及甚少。为此,在有关政府信息公开中具体配套制度方面的专门研究较少的情况下,本文试图对政府信息公开制度的关键机制——保密审查机制进行系统梳理,以政府信息公开中的保密审查制度为研究内容,结合《政府信息公开条例》和新《保密法》等相关法律法规和相关文献资料展开阐述和研究。分篇章、段落从公开政府信息与保密审查制度概述、政府信息公开中保密审查机制的理论基础、国外政府信息公开中保密审查制度的比较分析、当前我国政府信息公布开中的保密审查制度的现状及不足等方面展开论述,既从理论上探讨了保密审查机制的指导思想和原则、论证了保密审查机制的正当性和合理性,又结合《中华人民共和国政府信息公开条例》实施以来的政府信息公开实践,分析了保密审查机制在政府信息公开工作中尚存在的不足,同时运用比较研究的方法介绍了国外保密审查的相关经验,最终提出了完善我国政府信息公开中的保密审查制度的构想,以求推进政府信息公开保密审查机制更好地适应中国国情,并推动我国政治、经济、文化等各方面的长远发展。关键词:信息公开:保密审查;国家秘密;制度;研究。分类号: ABSTRACT ABSTRACT:As the core system oftheconstruction oftheopen ofgovernment information,confidentiality reviewsystem directly determines thescope and extentof theopen ofgovemment ireformation,and embodies theconstruction level ofthe socialistdemocracy and the ruleoflaw,advanced governing idea ofthegovernment and thenationalhumanrights security systemand ,scientific,elaborate, and defined power-and-responsibilityconfidentiality reviewmechanism oftheopen of govemment information findsthe solution tothedifficultproblems ontheconstruction andpractice oftheopen ofgovemment information system,and hastheinevitably important role on perfecting the democratic politics,promoting thereform of administrativesystem,supervising ans intheexerciseofexecutive power,preventing the abuse ofpower andcorruption,and the realization ofsocial resources sharing andtheconstructionoftheharmonious society ofsocialism.
