文档介绍：内容提要陪审制度是法院吸收非职业法官参与案件审理或审判的一项重要的司法制度,愈来愈受到世人的重视和关注。本论文主要从以下几个方面展开论述。第一部分为陪审制度概述,包括陪审制度的原初理念、陪审团制度发展史、参审制度发展史、人民陪审员制度发展史,以及陪审制度出现的原因在内的五方面内容。第二部分笔者以权力制约为视角,以权力主体、权力对象、权力运行过程为主线,分析陪审团制度、参审制度、人民陪审员制度的权力制约机制,并对三种制度进行横向比较。第三部分主要针对‘关于完普人民陪审员制度的决定》关于人民陪审员制度的规定,探讨其存在的闯题,并从立法、经济、文化、社会等几方面对所存问题进行剖析,分析原因。第四部分探讨人民陪审员制度如何完善。在本部分中,首先,笔者对人民陪审员制度的定位进行了阐述;随后,以权力制约机制为视角, 提出某些建议借以构建、完善人民陪审员制度;唯有如此,才能发挥人民陪审员制度独特的司法价值和功能。关键词: 比较;人民陪审员;权力制约;完善 Abstract The jury system is an importantsystem forthe court to absorb non-professional judges toparticipate mole a耐moreimportance蠲d attcl啦oILThe锄吐hor expounds thefollowing aspectsmainly inthisessay.
