文档介绍：污染环境罪司法解释研究中文摘要 I 污染环境罪司法解释研究中文摘要 I 污染环境罪司法解释研究中文摘要 I 污染环境罪司法解释研究中文摘要 2013 年 6月 19日,最高人民法院和最高人民检察院联合发布《关于办理环境污染刑事案件适用法律若干问题的解释》(以下简称《解释》) ,该解释对污染环境罪做了进一步完善,加大了对此类犯罪的惩罚力度,为我国环境保护司法实践提供了技术支撑,为从严治理环境污染,严厉打击环境污染犯罪提供了必要的法理依据。《解释》,共12条,主要有对实施刑法第 338 条涉及的“严重污染环境”的认定标准作了规定、对实施刑法第三百三十九条、第四百零八条规定涉及的“致使公私财产遭受重大损失或者严重危害人体健康”或者“致使公私财产遭受重大损失或者造***身伤亡的严重后果”的认定标准作了明确的规定、对实施刑法第三百三十八条、第三百三十九条规定的行为,如何明确“后果特别严重”的认定标准作了规定、明确了污染环境犯罪的从重处罚情节等。本文第一章介绍了本解释的制定背景,第二章以实际案例分析《解释》出台之后其实施效果,第三章介绍当前处理环境污染犯罪刑事司法存在的不足之处,如立法上有环境法益方面缺陷、主观故意与过失问题、严格责任问题以及客观方面缺陷,刑罚适用上有量刑偏轻,罚金刑适用等问题。第四章给出了一些完善我国环境刑事司法路径的一些建议。关键词: 污染环境罪;司法解释;刑法;立法完善作者: 赵宏轩指导老师: 焦艳鹏英文摘要污染环境罪司法解释研究 II A Study on Judicial Interpretation Relating to Environment Pollution Crime Abstract In June 19, 2013 , the Supreme Court and the Supreme People 's Procuratorate jointly issued " Interpretations on Environmental Criminal Cases applicable law Issues " ( hereinafter referred to as the "interpretation" ) ,this improve environmental pollution crime and plus punishment for such a crime .It provide technical support for Judicial practice, it helps to strictly control pollution, and crack down on environmental pollution offenses provided the necessary legal basis .
