文档介绍：Research on Administration Public Prosecution System A Thesis Submitted to Chongqing University InPartial Fulfillment of the Requirement for the Degree of Master of Profession By Ma Dengyu Supervised by Prof. Cheng Liao-Yuan Profession: Juris Master Law School ofChongqing University, Chongqing, China May,2011 重庆大学硕士学位论文中文摘要 I 摘要行政公诉目前在我国还只是一个学理概念,我国并没有建立行政公诉制度。但是,随着行政权的日益膨胀,行政主体的违法行政行为或者不作为对公共利益的侵害日益频繁和严重。由于我国现行行政诉讼法存有缺陷,公共利益受到违法行政行为或者不作为时,无法得到司法救济和保护。要弥补这种缺陷,建立行政公诉制度是最为适宜的选择。建构行政公诉制度是强化司法权对行政权监督约束的需要,更是维护公共利益的需要。现代诉权理论、权力制衡理论、法律监督理论为建立行政公诉制度提供了理论基础,外国立法实践为行政公诉提供了制度参考。行政公诉的核心在于行政公诉权,对行政公诉权进行合理的权能配置是建构行政公诉制度的关键。行政公诉制度的建立,离不开完善、合理的程序构造。行政公诉的基本原则贯穿于行政公诉的各个阶段,具有重要的指导和约束作用。明确界定行政公诉的受案范围才能使行政公诉有的放矢,行政公诉的基本程序应当包括诉前程序、审判程序和执行程序。关键词:行政公诉,公共利益,检察机关重庆大学硕士学位论文英文摘要 II ABSTRACT At present, administrative public prosecution in China is still just an academic concept. Our country has not established administrative public prosecution system. However, with the expansion of executive power, administrative subjects' illegal administrative act or omission infringe public interest more and more frequently and seriously. Because of the Administrative Procedure Law of the People's Republic of China is defective, when public interests are being violated by illegal administrative act or omission, it cannot get the judicial relief and protection. To remedy the defects, establishing administrative public system is the most appropriate choice. Establishing administrative public prosecution system is not only the need of supervising and restraining administrative power, but also the need of safeguarding public interests. Modern litigation theory, power balance theoryand legal supervision theory provides a theoretical basis for establishing administrative public prosecution system.
