摘要

随着工业化和城镇化的不断推进,我国上世纪年代以来涌现出了大批农
民工。他们在为中国经济社会做出重要贡献的同时,也改变了原有的社会秩序,
引发了不少社会问题。我国原有的工伤保险仅仅将城镇企事业单位的职工覆盖
在制度之下。农民工被定位为游离于城镇居民之外的边缘人群和弱势人群,不
享受工伤保险待遇。长期处于社会保障制度边缘的农民工及其社会保障问题,
尤其是农民工工伤保险问题,日显突出,亟待解决。
近年来,山西省层出不穷的煤矿﹑建筑工地农民工工伤事故纠纷,引起了
社会各界的普遍关注。而山西省的工伤保险工作起步较晚,目前仍处于探索阶
段。由于制度的缺失和不健全,山西省农民工工伤保险的推行更是步履艰难。
本文正是针对这种情况,结合山西省高风险行业多、农民工人数多的特点,通
过深入调研,探讨农民工工伤保险制度滞后的原因以及农民工对工伤保险的迫
切需求,并分别从经济环境、政策支持等方面论证了山西省建立农民工工伤保
险制度的现实可行性,进而对国内发达地区的成功经验进行了介绍,即对上海
模式和广东模式进行比较分析以借鉴有用的经验。在此基础上,本文结合山西
省的实际情况,针对现有农民工工伤保险在运行过程中存在的困难,对构建新
型农民工工伤保险——山西模式提出一些设想,并对其运行方式提出一些具体
措施。

Abstract

With the constant advancement of industrialization and urbanization,
a large number of migrant workers have emerged since the 80s of the last
century. They have made important contributions to China's economy and
society, and also changed the original order of society at the same time,
leading to a series of social problems. The former work-related injury
insurance of our country can only cover workers in urban enterprises and
anizations. Migrant workers are the people who are on the
edge of the crowd and disadvantage, being away from the urban residents.
They can not enjoy the benefits of work-related injury insurance. The
issues of migrant workers’ social security have e more and more
outstanding in the long run, especially migrant workers’ work-related
injury insurance.
In recent years, migrant workers in Shanxi coal mines and
construction sites have had injury accidents time after time, which has
attracted attentions from all sectors of society. Shanxi's migrant workers’
work-related injury insurance has started later and is still at an
exploratory stage. Due to the lack of plete system, the
implementation of migrant workers’ work-related injury insurance in
