摘要
环境影响评价制度对于保护环境发挥着重要的作用,在一定程度上有效的
减少了环境问题,被认为是一项非常有效的政策。而公众参与制度是环境影响
评价机制中的重要组成部分。公众参与作为促进决策民主化、科学化、制度化
的手段渗透到环境影响评价过程之中,更加有力地促进了环境与经济的协调发
展。世界各国和地区都以立法的形式确立公众参与环境影响评价制度,极大地
发挥了公众在保护环境过程中的作用。我国虽然对公众参与的规定较之此前有
了实质性的进展,但在公众参与环境影响评价的制度建设方面尚存在着立法及
具体操作层面上的诸多缺陷。这些将大大弱化了公众参与环境影响评价的实效,
也制约着环境影响评价制度中公众参与机制的形成。
本文通过对环评中公众参与制度进行分析,对我国现状进行分析,从而总结
我国现在存在的缺陷,在进一步对世界其他国家或者地区环评中公众参与制度
进行比较分析,总结经验,然后提出完善我们国家环评公众参与的建议。

Abstract
Environmental impact assessment system takes a very important place for the protection of the
environment, which is considered as an impactful police, and effective reduces the environmental
problem in a degree. As a important part of the Environmental impact assessment system, while, the
public participation greatly improve the harmonious relationships between the environment and the
economics. Most countries and other areas have establish the public participant in the environment
impact assessment by through legislation, those polices greatly make the public participant system
play important rule in proceed of the environment protection. While our country’s public
participation system made substantial progress, but there are still a number of ings in the
public participation in environmental impact assessment system for building surviving in the
legislation and concrete practical areas, and those ings badly weaken the effectiveness of
the public participation in environmental impact assessment, and also restrict the formation of a
mechanism for public participation the environmental impact assessment system.
Base on analyzing the public participation system in the environment impact assessment,
summarizing the deficiencies existed in our country now, and then analyze the experiences of the
public participation in environmental impact assessment system of other countries or areas w
