论我国农村社会养老保险法律制度的完善

摘要
农村社会养老保险法律是我国整个社会保障法律的重要组成部分。一个现
代化的、适合我国经济社会发展的农村社会养老保险法律制度,直接关系到农
村改革的成败、社会的稳定和经济的发展。然而,我国相关立法滞后,只有国
务院民政部制定的《县级农村社会养老保险基本方案》对农村社会养老保险的
基本内容做了一些原则性的规定。农村社会养老保险制度推行以来在实践上取
得了丰富的经验,但是由于农村社会养老保险法律制度本身的缺陷,建立农村
社会养老保险制度出现了许多障碍性因素,因此迫切需要完善该法律制度。
在我国,养老保险法律制度本质上是一种非均衡制度,呈现出典型的二元
结构特征:占人口的农民很少享受政府提供的养老保险,而占人口的城
镇居民享受较完善的养老保险。笔者以为,这不仅仅是城乡二元经济结构导致
的结果,也是国家以有限的资源解决城市紧迫问题的政策性选择。通常,由政
府提供的养老保险法律制度是一种准公共产品,农村社会养老保险属于国家管
理的一项社会事务,属于政府的职能。目前农村养老保险的制度缺陷和资金短
缺严重阻碍农村经济的可持续发展和农民收入水平的提高,影响社会安定和社
会公正。单纯依靠土地保障和家庭养老难以解决老龄化挑战和农民养老危机,
发展和完善农村社会养老保险法律制度势在必行。
本文分析了农村社会养老保险法律制度的现状,指出了农村社会养老保险
工作中存在的缺陷,研究了法理学、社会学、经济学方面的理论,并结合现实
的需求,说明了完善农村社会养老保险法律制度有着深刻的理论基础和现实意
义。那么在当前农村社会养老保险法律还不健全的初级阶段,如何来完善呢,
笔者认为:必须立足于中国的国情,立足于农村的具体情况,作为农民自身应
转变传统的“养儿防老”观念,从整体利益、长远利益出发,自愿参加社会养
老保险;而作为政府,应认识到参加社会养老保险是农民的权利,国家应加大
在农村社会养老保险中的财政支持。最后,笔者从五个方面就我国实行中国式
的农村社会养老保险法律制度进行了建设性构想。以期有一定客观参考作用。

Abstract
The rural social endowment insurance law is an ponent
of the law of the entire social security in our country. A modern, suitable
for China's economic and social development of rural social endowment
insurance legal system is directly related to the ess of rural reform,
social stability and economic development. Only the State Council of the
Ministry of Civil Affairs to develop the "basic county-level rural social
endowment insurance programme", and made some principle on the basic
elements of the rural social endowment insurance. Since the carry-out
of the social endowment insurance system, rich experience has been
achievede. But due to the ings of the social endowment
insurance law in the rural area itself, the establishment of the social
endowment insurance system has met great deal of obstacles. So the
improvement of the law system is pressing.
