后配额时代中国纺织品服装出口法律问题研究

摘要
年月日,纺织品配额的如期取消,我国纺织品服装出口将面临着前
所未有的机遇和挑战。配额取消后,中国纺织品服装业在国际市场中无论宏观
环境,还是微观运作环境都将发生新的变化。但是,我们应该清楚的认识到,
纺织品配额的取消虽然有利于改善我国的纺织品服装出口市场环境,但并不意
味着对我国纺织品服装出口的全面放行,各国一些传统的进口限制措施依然有
效,后配额时代新的贸易壁垒也将层出不穷。
基于上述认识,本文首先分析了后配额时代中国纺织品服装出口现状和面
临的主要问题,在对我国纺织品服装出口法律制度缺欠的思考以及典型发展中
国家纺织品服装出口经验的借鉴的基础上,最后从法律角度就相应的解决措施
提出若干粗浅的建议,希望能对我国纺织品服装出口法律制度的完善有所裨益。

ABASTRACT
On January 1, 2005, the textile quota was canceled on the
fixed day, and our country's textile clothing exportation will
face the unprecedented opportunity and the challenge. After
the quota cancellation, Chinese textile apparel industry in
international market will have the new change both in the
macroscopic environment and the microscopic operation
environment. However, we should realize it clearly that the
global textile quota's cancellation doesn't mean the
exportation of our country's textile clothing pletely
allowed to pass although it is advantage in improving our
country's exportation market environment, the various
traditional import limit measures of different countries are still
valid, some new trade barriers will also emerge one after
another incessantly in the latter quota time.
Based on the above understanding, firstly this article has
analyzed Chinese textile clothing exportation's present
situation and the main questions in the after quota era,
pondering in our country's textile clothing exportation law
system lacking, as well as the model foundation of typical
developing nation's textile clothing exportation experience.
Finally I put forward some shallow proposals from the legal

angle on the corresponding solution measure: I hope it can
benefit our country's textile clothing exportation law system
consummation.
